  1                      A bill to be entitled

  2         An act relating to gasoline sales; amending s.

  3         526.141, F.S.; requiring attendants at certain

  4         service stations to pump gasoline for certain

  5         persons transporting children; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (a) of subsection (5) of section

11  526.141, Florida Statutes, is amended to read:

12         526.141  Self-service gasoline stations; attendants;

13  regulations.--

14         (5)(a)  Every full-service gasoline station offering

15  self-service at a lesser cost shall require an attendant

16  employed by the station to dispense gasoline from the

17  self-service portion of the station to any motor vehicle:

18         1.  That properly displays displaying an exemption

19  parking permit as provided in s. 316.1958 or s. 320.0848 or a

20  license plate issued pursuant to s. 320.084, s. 320.0842, s.

21  320.0843, or s. 320.0845 when the person to whom such permit

22  has been issued is the operator of the vehicle and such

23  service is requested; or

24         2.  In which a child 5 years of age or younger is being

25  transported in a child restraint pursuant to s. 316.613(1)

26  when such service is requested by the operator and there is no

27  other person in the vehicle old enough to drive.

29  Such stations shall prominently display a decal no larger than

30  8 square inches on the front of all self-service pumps clearly

31  stating the requirements of this paragraph subsection and the

  1  penalties applicable to violations of this paragraph

  2  subsection.  The Department of Agriculture and Consumer

  3  Services shall enforce this requirement.

  4         Section 2.  This act shall take effect July 1, 1999.

  7                          SENATE SUMMARY

  8    Requires full-service gasoline stations that offer
      self-service gasoline at lower cost to provide an
  9    attendant to dispense gasoline from the self-service
      pumps to certain persons with children age 5 and under in
10    the motor vehicle.
