13         Senate Amendment (with title amendment) 

14         On page 4, between lines 11 and 12,

15

16  insert:

17         Section 2.  Section 944.116, Florida Statutes, is

18  created to read:

19         944.116  Payments in lieu of taxes by the Correctional

20  Privatization Commission.--

21         (1)  The Correctional Privatization Commission created

22  in s. 957.03 shall include any payments in lieu of taxes for

23  facilities in the total costs of running private facilities,

24  and such payments shall be factored into any equation to

25  determine if state mandated cost savings have been met.

26         (2)  Buildings and other improvements to real property

27  of existing facilities, including future additions to existing

28  facilities, which are financed under chapter 957 and which are

29  leased to the Correctional Privatization Commission are

30  considered to be owned by the Correctional Privatization

31  Commission for the purposes of this section whereby the terms

 1  of the leases, the buildings, and other improvements will

 2  become the property of the state at the expiration of the

 3  leases. For any facility that is bid and built under the

 4  authority of requests for proposals made by the Correctional

 5  Privatization Commission between December 1993 and October

 6  1994 and that are operated by a private vendor, a payment in

 7  lieu of taxes, from funds appropriated for the Correctional

 8  Privatization Commission, shall be paid until the expiration

 9  of the leases to local taxing authorities in the local

10  government in which the facility is located in an amount equal

11  to the ad valorem taxes assessed by counties, municipalities,

12  school districts, and special districts.

22         An act relating to correctional facilities;

23         creating s. 944.116, F.S.; requiring specified

24         payments to be included in the costs of running

25         private correctional facilities and to be

26         factored in when calculating cost savings;

27         providing for payments in lieu of taxes for

28         correctional facilities bid and built between

29         specified dates; creating s. 944.115, F.S.;
