17  and insert in lieu thereof:

18         (8)  RULES.--The State Board of Education may adopt

19  rules pursuant to ss. 120.536(1) and 120.54 to implement the

20  provisions of this section.  Rules shall include penalties for

21  noncompliance with subsections (3), (4), and (5).  However,

22  the inclusion of eligible private schools within options

23  available to Florida public school students does not expand

24  the regulatory authority of the state, its officers, or any

25  school district to impose any additional regulation of private

26  schools beyond those reasonably necessary to enforce

27  requirements expressly set forth in this section.

28         (9)  PRIVATE SCHOOL LIABILITY--It is an unlawful and

29  deceptive trade practice and an unfair and deceptive act under

30  Part II of chapter 501 for a private school accepting an

31  opportunity scholarship to violate paragraphs (b), (d), (g),
