11  Senator Kirkpatrick moved the following amendment to amendment

14         Senate Amendment (with title amendment) 

15         On page 100, between lines 15 and 16,

16

17  insert:

18         Section 45.  Subsection (3) of section 230.303, Florida

19  Statutes, is amended to read:

20         230.303  Superintendent of schools.--

21         (3)  Notwithstanding provisions of chapter 145 or this

22  chapter to the contrary, the annual salaries of elected

23  superintendents of schools for 1993 and each year thereafter

24  shall be established at the same amounts as those

25  superintendents were paid for fiscal year 1991-1992, adjusted

26  by each annual increase provided for in chapter 145.  Any

27  salary previously paid to elected superintendents which was

28  consistent with chapter 145 and this section is hereby

29  ratified and validated. By June 30, 2002, at least 5 percent

30  of the salary of elected superintendents must be based on the

31  annual performance of students as measured by state
