  1                      A bill to be entitled

  2         An act relating to traffic stop statistics;

  3         directing the Florida Department of Law

  4         Enforcement to conduct a study of routine

  5         traffic stops by law enforcement officers;

  6         providing for factors to be included in the

  7         study; providing for an annual report;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Traffic stop statistics.--The Florida

13  Department of Law Enforcement shall conduct a study of stops

14  made by law enforcement officers for routine traffic

15  violations.  Such study shall include collection and analysis

16  of appropriate available data, which shall include, but not be

17  limited to, the following:

18         (1)  The number of individuals stopped for routine

19  traffic violations.

20         (2)  Identifying characteristics of the individuals

21  stopped, including race and/or ethnicity, as well as the

22  approximate age of the individuals stopped.

23         (3)  The traffic infraction alleged to have been

24  committed that led to the stop.

25         (4)  Whether a search was instituted as a result of the

26  stop.

27         (5)  How the search was instituted, if the traffic stop

28  resulted in a search.

29         (6)  The rationale for a search.

30         (7)  Whether any contraband was discovered in the

31  course of a search.

  1         (8)  The nature of any contraband discovered in the

  2  course of a search.

  3         (9)  Whether any warning or citation was issued as a

  4  result of the stop.

  5         (10)  Whether an arrest was made as a result of either

  6  the stop or the search.

  7         (11)  The benefit of traffic stops with regard to the

  8  interdiction of drugs and the proceeds of drug trafficking,

  9  including the approximate quantity of drugs and value of drug

10  proceeds seized on an annual basis as a result of routine

11  traffic stops.

12         (12)  Whether any items were seized for forfeiture.

14  The information gathered as a result of this study shall be

15  compiled as a report on an annual basis, a copy of which shall

16  be provided to the Governor and Cabinet, the President of the

17  Senate, the Speaker of the House of Representatives, the

18  Minority Leader of the Senate, and the Minority Leader of the

19  House of Representatives.

20         Section 2.  This act shall take effect upon becoming a

21  law.
