1 A bill to be entitled
2 An act relating to motor vehicle airbags;
3 providing a short title; providing definitions;
4 requiring a record of any sale, replacement, or
5 installation of an airbag; specifying required
6 information; providing for inspection and
7 disclosure of such records; prohibiting certain
8 activities; providing penalties; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) Short title.--This section may be
14 cited as the "Airbag Antitheft Act."
15 (2) Definitions.--"Airbag" means an inflatable
16 restraint system that is designed to be installed and to
17 operate in a motor vehicle to activate in the event of a
18 crash. A "salvaged airbag" is one which has been removed from
19 a motor vehicle.
20 (3) Sale of salvaged airbags; replacement of airbags;
21 records.--Any person who purchases or sells any salvaged
22 airbag or replaces an airbag shall maintain a manual or
23 electronic record of the transaction, which shall include the
24 identification number of the airbag; the vehicle
25 identification number of the vehicle from which a salvaged
26 airbag was removed, if known; the name, address, and driver
27 license number or other means of identification of the person
28 from whom a salvaged airbag was purchased; and to whom an
29 airbag is sold or for whom an airbag is replaced. Such record
30 shall be made available for inspection upon demand by any law
31 enforcement officer of this state or other authorized

1 representative of the agency charged with administration of
2 this section. Upon request, information within a portion of
3 such record pertaining to a specific transaction shall be
4 provided to an insurer or a consumer.
5 (4) Prohibition; penalties.--
6 (a) It is unlawful for any person to knowingly
7 possess, sell, or install a stolen uninstalled airbag, any
8 airbag from which the manufacturer's part identification
9 number has been removed, altered, or defaced, or an airbag
10 taken from a stolen motor vehicle. Any person who violates
11 this provision commits a felony of the third degree,
12 punishable as provided in s. 775.082, s. 775.083, or s.
13 775.084, Florida Statutes.
14 (b) Any person who fails to maintain complete and
15 accurate records or prepare complete and accurate documents
16 required by this act commits a misdemeanor of the first
17 degree, punishable as provided in s. 775.082 or s. 775.083,
18 Florida Statutes.
19 Section 2. This act shall take effect October 1, 1999.
