11  The Committee on Banking and Insurance recommended the

12  following amendment:

14         Senate Amendment (with title amendment) 

15         On page 7, between lines 14-15,

16

17  insert:

18         Section 2.  Paragraph (e) is added to subsection (2) of

19  section 110.12315, Florida Statutes, to read:

20         110.12315  Prescription drug program.--

21         (2)

22         (e)  The Division of State Group Insurance may not

23  implement a prior authorization program or a restricted

24  formulary program that restricts access to prescription drugs

25  for an enrollee who is not a member of a health maintenance

26  organization beyond the provisions of paragraph (b), which

27  relate specifically to generic equivalent drugs for

28  prescriptions, or the provisions of paragraph (d), which

29  relate specifically to starter dose programs or to the

30  dispensing of long-term maintenance medications. The prior

31  authorization program expanded under section 8 of the

 1  1998-1999 General Appropriations Act is terminated. If this

 2  paragraph conflicts with any provisions of the General

 3  Appropriations Act or any act that implements the General

 4  Appropriations Act, the Legislature intends that this

 5  paragraph shall prevail.

10         On page 1, line 8, after the semicolon

12  insert:

13         amending s. 110.12315, F.S.; prohibiting the

14         Division of State Group Insurance from

15         implementing a prior authorization program or a

16         restricted formulary program that restricts

17         access to prescription drugs, except under

18         certain circumstances; providing legislative

19         intent;
