13         Senate Amendment (with title amendment) 

14         On page 7, between, lines 18 and 19,

15

16  insert:

17         Section 4.  Limitation on employment of

18  noninstructional personnel by school districts.--

19         (1)(a)  Notwithstanding any other law, the Department

20  of Education may establish limitations on the number of

21  noninstructional personnel that may be employed by school

22  districts, based on the total number of full-time-equivalent

23  students enrolled in the district.

24         (b)  As used in this section, the term

25  "noninstructional personnel" means school district personnel

26  who:

27         1.  Are classified as administrative personnel or

28  managers under section 236.685, Florida Statutes; and

29         2.  Do not perform any instructional duties.

30         (2)(a)  Based on the prior year's enrollment, the

31  department shall classify the school districts as follows:

 1  the 20 districts with the fewest number of

 2  full-time-equivalent students shall be classified as

 3  small-sized districts; the 10 districts with the largest

 4  number of full-time-equivalent students shall be classified as

 5  large-sized districts; and the remaining districts shall be

 6  classified as medium-sized districts.

 7         (b)  By July 1 of each year, the department shall

 8  establish a ratio for the school districts in each of the

 9  three size classifications. The ratio must specify the maximum

10  percentage of noninstructional personnel to

11  full-time-equivalent students which a school district may

12  employ. The department may not establish a ratio that exceeds

13  the average ratio of noninstructional personnel to

14  full-time-equivalent students which existed within a

15  particular district size classification during the 1997-1998

16  school year.

17         (c)  In addition, the department shall determine the

18  average annual salary, including the cost of benefits, for

19  noninstructional personnel employed by school districts in

20  each of the three size classifications.

21         (3)  The department shall determine each school year if

22  any school district exceeds the maximum number of positions

23  allowed for noninstructional personnel. For each position that

24  exceeds the maximum allowable number within a district, the

25  department shall deduct an amount equal to 50 percent of the

26  average cost of that position from the state funds allocated

27  to the district.

13         district; requiring that the department

16         noninstructional personnel to

17         full-time-equivalent students; limiting the

18         maximum ratios that the department may

19         establish; requiring a reduction in state funds

20         for any school district that exceeds the

21         maximum percentage of noninstructional

22         personnel;
