3 services; amending s. 409.9122, F.S.; requiring
4 access to and reimbursement for certain
5 services relating to child abuse, abandonment,
6 or neglect without preauthorization; amending
7 s. 641.31, F.S.; proscribing preauthorization
8 for certain services relating to child abuse,
9 abandonment, or neglect; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (13) is added to section
15 409.9122, Florida Statutes, 1998 Supplement, to read:
16 409.9122 Mandatory Medicaid managed care enrollment;
17 programs and procedures.--
18 (13) The agency shall provide a recipient enrolled in
19 a managed care plan or with a MediPass provider, without
20 preauthorization, direct access and reimbursement for services
21 rendered by a child protection team, established pursuant to
22 s. 39.303, for diagnosis and evaluation services related to
23 alleged child abuse, abandonment, or neglect.
24 Section 2. Subsection (36) is added to section 641.31,
25 Florida Statutes, 1998 Supplement, to read:
26 641.31 Health maintenance contracts.--
27 (36) Notwithstanding any other provision of this
28 section, a health maintenance contract that provides services
29 to a minor child of a subscriber shall not require any
30 preauthorization for services rendered by a child protection
31 team, established pursuant to s. 39.303, for diagnosis and

1 evaluation services related to alleged child abuse,
2 abandonment, or neglect.
3 Section 3. This act shall take effect July 1, 1999.
