11  Senator Campbell moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 5, between lines 6 and 7,

15

16  insert:

17         Section 3.  Subsection (2) of section 849.094, Florida

18  Statutes, is amended to read:

19         849.094  Game promotion in connection with sale of

20  consumer products or services.--

21         (2)  It is unlawful for any operator:

22         (a)  To design, engage in, promote, or conduct such a

23  game promotion, in connection with the promotion or sale of

24  consumer products or services, wherein the winner may be

25  predetermined or the game may be manipulated or rigged so as

26  to:

27         1.  Allocate a winning game or any portion thereof to

28  certain lessees, agents, or franchises; or

29         2.  Allocate a winning game or part thereof to a

30  particular period of the game promotion or to a particular

31  geographic area.;

 1         (b)  Arbitrarily to remove, disqualify, disallow, or

 2  reject any entry.;

 3         (c)  To fail to award prizes offered.;

 4         (d)  To print, publish, or circulate literature or

 5  advertising material used in connection with such game

 6  promotions which is false, deceptive, or misleading.; or

 7         (e)  To require an entry fee, payment, or proof of

 8  purchase as a condition of entering a game promotion.

 9         (f)  To fail to make clearly and conspicuously on any

10  direct-mail material offering a chance to enter a sweepstakes

11  game promotion in 16-point font set out in a separate and

12  blocked section the following disclosures:

13         1.  The statement "This is a game promotion that

14  involves chance. You have not automatically won."

15         2.  The name and physical address of the operator.

16         3.  A toll-free number of the operator whom persons may

17  call for answers to questions they have concerning the game

18  promotion.
