  1                      A bill to be entitled

  2         An act relating to art in state buildings;

  3         amending s. 255.043, F.S.; authorizing a

  4         specified portion of the total appropriation

  5         for the original construction of a state

  6         building which provides public access to be

  7         used for the acquisition of works of art;

  8         reducing the limit of the total appropriation;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 255.043, Florida Statutes, is

14  amended to read:

15         255.043  Art in state buildings.--

16         (1)  Each appropriation for the original construction

17  of a state building which provides public access may shall

18  include an amount of up to 0.25 0.5 percent of the total

19  appropriation for the construction of the building, not to

20  exceed $50,000 $100,000, to be used for the acquisition of

21  works of art produced by, but not limited to, Florida artists

22  or craftspersons.  Those works of art acquired shall be

23  displayed for viewing in public areas in the interior or on

24  the grounds or the exterior of the building and not in private

25  offices or areas with limited public access.

26         (2)  The Department of Management Services, the Board

27  of Regents, or other state agencies receiving appropriations

28  for original constructions shall notify the Florida Arts

29  Council and the user agency of any construction project which

30  is eligible under the provisions of this section. The

31  Department of Management Services, the Board of Regents, or

  1  other state agency shall determine the amount authorized to be

  2  made available for purchase or commission of works of art for

  3  each project and shall report these amounts to the Florida

  4  Arts Council and the user agency.  Payments therefor shall be

  5  made from funds appropriated for fixed capital outlay

  6  according to law.

  7         (3)  The selection of artists or craftspersons shall be

  8  the responsibility of the user agency.  The final approval of

  9  any recommendation for the purchase of or commissioning of

10  works of art shall be consistent with the art selection

11  process pursuant to rule promulgated by the Department of

12  State.  The approval of any invoice for payment for any

13  purchase of or commissioning of works of art shall be the

14  responsibility of the user agency.

15         (4)  This section shall not apply to any funds for the

16  construction of public buildings if the funds were

17  appropriated prior to July 1, 1979.

18         (5)  The Department of State shall be authorized to

19  promulgate rules to implement this section.

20         Section 2.  This act shall take effect July 1, 1999.

      With respect to chapter 255, F.S., relating to public
25    property and publicly owned buildings, revises current
      provisions of law to authorize, rather than require, that
26    each appropriation for the original construction of a
      state building which provides public access include an
27    amount of up to 0.25 percent, rather than 0.5 percent as
      is currently provided, of the total appropriation for the
28    construction of the building, not to exceed $50,000,
      rather than $100,000 as is currently provided, to be used
29    for the acquisition of works of art produced by, but not
      limited to, Florida artists or craftspersons.
