2 An act relating to motor vehicles; amending s.
3 316.2126, F.S.; authorizing the use of
4 golf/utility carts by municipalities for
5 municipal purposes and subject to certain
6 conditions; amending s. 320.01, F.S.; defining
7 the term "golf/utility cart"; amending s.
8 320.105, F.S.; exempting golf/utility carts
9 from requirements to display license plates;
10 amending s. 322.04, F.S.; exempting certain
11 operators of golf/utility carts from
12 requirements of obtaining a driver's license;
13 amending s. 325.203, F.S.; exempting
14 golf/utility carts from inspection
15 requirements; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Section 316.2126, Florida Statutes, is
20 amended to read:
21 316.2126 Use of golf/utility golf carts by certain
22 municipalities.--In addition to the powers granted by ss.
23 316.212 and 316.2125, municipalities older than 400 years old
24 are hereby authorized to utilize golf/utility golf carts, as
25 defined in s. 320.01, upon any state, county, or municipal
26 roads located within the corporate limits of such
27 municipalities, subject to the following conditions:
28 (1) Golf/utility Golf carts operated beyond the
29 authority granted in ss. 316.212 and 316.2125 may only be
30 operated by municipal employees for municipal purposes,

1 including, but not limited to, police patrol, traffic
2 enforcement, and inspection of public facilities.
3 (2) In addition to the safety equipment required in s.
4 316.212(6), such golf/utility golf carts must be equipped with
5 sufficient lighting and turn signal equipment.
6 (3) The golf/utility golf carts may only be operated
7 on state roads that have a posted speed limit of 30 miles per
8 hour or less.
9 Section 2. Subsection (22) of section 320.01, Florida
10 Statutes, is amended to read:
11 320.01 Definitions, general.--As used in the Florida
12 Statutes, except as otherwise provided, the term:
13 (22) "Golf/utility Golf cart" means a motor vehicle
14 designed and manufactured for operation on a golf course or
15 used for sporting, utility, or recreational purposes, but the
16 term does not include an all-terrain vehicle as defined in s.
17 316.2074.
18 Section 3. Section 320.105, Florida Statutes, is
19 amended to read:
20 320.105 Golf/utility Golf carts;
21 exemption.--Golf/utility Golf carts, as defined in s. 320.01,
22 when operated in accordance with s. 316.212 or s. 316.2126,
23 are exempt from provisions of this chapter which require the
24 registration of vehicles or the display of license plates.
25 Section 4. Paragraph (e) of subsection (1) of section
26 322.04, Florida Statutes, is amended to read:
27 322.04 Persons exempt from obtaining driver's
28 license.--
29 (1) The following persons are exempt from obtaining a
30 driver's license:

1 (e) Any person operating a golf/utility golf cart, as
2 defined in s. 320.01, which is operated in accordance with the
3 provisions of s. 316.212.
4 Section 5. Paragraph (c) of subsection (4) of section
5 325.203, Florida Statutes, is amended to read:
6 325.203 Motor vehicles subject to annual inspection;
7 exemptions.--
8 (4) The following motor vehicles are not subject to
9 inspection:
10 (c) Golf/utility Golf carts, as defined in s. 320.01.
11 Section 6. This act shall take effect upon becoming a
12 law.

15 SENATE SUMMARY
16 Substitutes the term "golf/utility cart," as defined, for
the term "golf cart." Authorizes municipalities of any
17 vintage to use golf/utility carts for municipal purposes.
