17 Section 1. (1) The Proposed Creation of Hialeah
18 County Study Commission is created.
19 (2) The commission shall be composed of the following
20 15 members, who must be appointed within 45 days after the
21 effective date of this act.
22 (a) Six members selected by the Governor, as follows:
23 one member of the Miami-Dade County Commission; one member of
24 the South Florida Regional Planning Council who does not
25 reside within the boundaries of Miami-Dade County; two
26 representatives of the business community who reside within
27 the boundaries of Miami-Dade County; and two citizen members
28 who reside within the boundaries of Miami-Dade County.
29 (b) Two members of the Senate, selected by the
30 President of the Senate.
31 (c) Two members of the House of Representatives,

1 selected by the Speaker of the House of Representatives.
2 (d) In addition, the commission shall include: the
3 mayor of the City of Hialeah, who shall serve as the
4 chairperson of the commission; the executive director of the
5 Department of Revenue, or his or her designee; the Secretary
6 of Community Affairs, or his or her designee; the Commissioner
7 of Education, or his or her designee; and the Attorney
8 General, or his or her designee.
9 (3) A technical assistance group is established to
10 assist the commission in its activities and serve as ex
11 officio members of the commission. The technical assistance
12 group shall be composed of one representative from each of the
13 following: the Florida Association of Counties; the Florida
14 League of Cities; the Florida Association of Special
15 Districts; the Florida Association of Court Clerks and
16 Comptrollers; the Florida Tax Collectors, Inc.; the Florida
17 Association of Property Appraisers; the Florida Sheriffs
18 Association; the Florida Supervisors of Election Association;
19 the Florida Government Financial Officers' Association; and
20 the School Board Association of Florida.
21 (4) Vacancies on the commission shall be filled in the
22 same manner as the original appointments.
23 (5) Commission members shall not receive remuneration
24 for their services, but are entitled to be reimbursed by the
25 Legislative Committee on Intergovernmental Relations for
26 travel and per diem expenses in accordance with section
27 112.061, Florida Statutes. Travel and per diem expenses of ex
28 officio members shall be assumed by their respective
29 associations.
30 (6) The commission shall act as an advisory body to
31 the Governor and the Legislature.

1 (7) The commission shall convene its initial meeting
2 within 60 days after the effective date of this act. At its
3 initial meeting, the commission shall adopt rules of procedure
4 for conducting its business. Thereafter, the commission shall
5 convene monthly, or more frequently at the call of its
6 chairperson.
7 (8) The commission shall review the feasibility of
8 creating a new county, including cost estimates and related
9 issues associated with such creation, out of portions of
10 Miami-Dade County in the area commonly known as Hialeah.
11 Towards that end, the commission shall:
12 (a) Identify problems with the existing structure of
13 local governments and consider the manner in which a new
14 government may address such problems;
15 (b) Identify and analyze the legal issues associated
16 with the creation of the new county;
17 (c) Describe all procedures and processes for
18 establishing a new county, subject to general law and the
19 Florida Constitution;
20 (d) Identify the estimated fiscal impacts to
21 Miami-Dade County, the newly created county, and all affected
22 existing general-purpose and limited-purpose local
23 governments;
24 (e) Identify the costs associated with establishing
25 the offices of the constitutional officers of the new county
26 and the costs associated with the transfer of all relevant
27 records;
28 (f) Estimate the expenditures and revenue sources for
29 the new county; and
30 (g) Establish a 5-year projection of revenue sources
31 and a 5-year proposed budget of expenditures.

1 (9) The commission is encouraged to consider other
2 issues that relate to the creation of the new county,
3 including:
4 (a) The extent that a new county may negatively affect
5 the existing county's ability to equitably finance and provide
6 county services to its remaining residents;
7 (b) The extent that the demographic characteristics of
8 the new county should be similar to the remaining county with
9 respect to income, race, ethnicity, and age;
10 (c) The extent that the general tax base of the new
11 county should be similar to the tax base of the remaining
12 county; and
13 (d) The extent that the new county should be an area
14 separate and distinct from the existing county.
15 (10) State and local governmental entities shall
16 cooperate in providing information and assistance requested by
17 the commission which is necessary to conduct its review.
18 (11) The commission shall report its findings to the
19 Governor and the Legislature by January 31, 2000.
20 (12) The commission shall expire June 1, 2000.
21 Section 2. (1) The Legislative Committee on
22 Intergovernmental Relations may employ staff or enter into
23 contracts to provide technical support for the Proposed
24 Creation of Hialeah County Study Commission, and may expend
25 funds appropriated to the committee for carrying out the
26 official duties of the commission.
27 (2) The sum of $150,000 is appropriated to the
28 Legislative Committee on Intergovernmental Relations from the
29 General Revenue Fund to be used to carry out the duties of the
30 Proposed Creation of Hialeah County Study Commission.
31 Section 3. This act shall take effect upon becoming a
