12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 7.275, Florida Statutes, is created
15 to read:
16 7.275 Hialeah County.--The boundary lines of Hialeah
17 County are as follows:

19 Beginning at the southeast corner of Section 20, Township 53
20 South, Range 41 East, run 660 feet northwardly along the east
21 line of such Section 20 to a point, such point being the Point
22 of Beginning. From the Point of Beginning run northwardly
23 along the east line of Section 20, such east line of Section

11 point; thence run South 87 degrees, 45 minutes, 26 seconds
12 East along a line for a distance of 1,010.75 feet to a point
13 on the east line of Section 36; thence run southwardly along
14 the east line of Section 36 a distance of 2,570.41 feet, more
15 or less, to the Point of Beginning.
16 Section 3. All real property the title to which is
17 vested in Dade County and which is located within the area
18 comprising Hialeah County is transferred to Hialeah County on
19 the effective date of this act. Personal property the title to
20 which is vested in Dade County is transferred to Hialeah
21 County on the effective date of this act in an amount equal to
22 the proportion which the assessed value of taxable property in
23 the area comprising Hialeah County bears to the assessed value
24 of taxable property in Dade County as of the previous January
25 1. Hialeah County shall assume responsibility for the
26 obligations of Dade County which exist on the effective date
27 of this act in an amount equal to the proportion which the
28 assessed value of taxable property in the area comprising
29 Hialeah County bears to the assessed value of taxable property
30 in Dade County as of the previous January 1.

1 Section 4. Notwithstanding any other provision of law,
2 the Board of County Commissioners of Dade County shall call
3 and hold special elections that coincide with the 2000 primary
4 and general elections at which officers for Hialeah County
5 shall be selected. The Board of County Commissioners of
6 Hialeah County shall reimburse Dade County for any costs of
7 conducting the election required by this section which are in
8 excess of the costs that would otherwise be incurred. Electors
9 of the area comprising Hialeah County are eligible to vote in
10 such elections.
11 Section 5. This act shall take effect only upon the
12 approval by a majority vote of those qualified electors
13 residing within the proposed Hialeah County boundaries as
14 described in section 1, voting in a referendum election to be
15 called by the Miami-Dade County Commission and to be held on
16 September 1, 1999, in accordance with the provisions of law
17 relating to elections currently in force.

22 The CS differs from the bill in that it prohibits the creation
of the new county until it is approved by a majority vote of
23 qualified electors of the proposed Hialeah County.
