  1                      A bill to be entitled

  2         An act creating the Surface Water Improvement

  3         and Management Trust Fund; providing its

  4         purposes; providing a conditional effective

  5         date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  The Surface Water Improvement and

10  Management Trust Fund is established within the Department of

11  Environmental Protection. The fund shall be credited with

12  proceeds from the excise tax on documents as provided in

13  section 201.15(6), Florida Statutes.

14         (2)  The fund must be used by the state's water

15  management districts for fixed capital outlay projects,

16  including wastewater treatment and stormwater management

17  facilities, which implement surface water improvement and

18  management plans approved under section 373.456, Florida

19  Statutes, as they exist on July 1, 2000.

20         Section 2.  This act shall take effect on the effective

21  date of Senate Bill 908, but it shall not take effect unless

22  it is enacted by a three-fifths vote of the membership of each

23  house of the Legislature and unless SB 908, 1999 Regular

24  Session, becomes a law.
