18 409.26731 Certification of local funds as state match
19 for federally funded services; federal waivers.--In order to
20 implement Specific Appropriations 330 and 334 through 352 of
21 the 1997-1998 General Appropriations Act, The Department of
22 Children and Family Services is authorized to certify local
23 funds not to exceed $5 million as state match for children's
24 mental health services funded by Medicaid in excess of the
25 amount of state general revenue matching funds appropriated
26 for such services through the 1997-1998 General Appropriations
27 Act. The department is also authorized to certify local funds
28 not to exceed $5 million as state match for eligible Title
29 IV-E, expenditures services for children under the supervision
30 and custody of the state in excess of the amount of state
31 general revenue matching funds appropriated for such services

1 by the 1997-1998 General Appropriations Act in Specific
2 Appropriations 334 through 352. Federal Medicaid or Title IV-E
3 funds provided to the state as federal financial participation
4 consequent to certified local matching funds shall
5 automatically be passed through to the local entity that
6 provided the certified the local match. Notwithstanding the
7 provision of s. 215.425, all such federal Title IV-E funds
8 earned for the current fiscal year as a result of utilizing
9 certified local match, except for up to five percent of such
10 earnings which the department is authorized to retain for
11 administrative processes, shall be distributed as set forth in
12 this section and this process shall not impact the
13 department's allocation to any district. All of the provisions
14 of this section are based upon federal approval of the
15 provisions as specifically limited in this section and shall
16 not become effective if any further modifications are required
17 of the state, unless and until federal approval has been
18 obtained. The Agency for Health Care Administration is
19 authorized to apply for federal waivers to modify the state
20 Medicaid plan to include optional Medicaid in-home and
21 therapeutic services for Medicaid-eligible children if the
22 state match for such services is provided by local funds
23 certified by the department as state match. Such services
24 shall be available only in communities that provide the
25 certified match. The department shall annually prepare a
26 report to be submitted to the Legislature no later than
27 January 1 documenting the specific activities undertaken
28 during the previous fiscal year pursuant to this section.
