  1                      A bill to be entitled

  2         An act relating to public records; providing an

  3         exemption from public records requirements for

  4         donors to a direct-support organization for the

  5         Florida Affordable College Trust; providing an

  6         expiration date; providing a finding of public

  7         necessity; providing a contingent effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  The identity of a donor to the

13  direct-support organization for the Florida Affordable College

14  Trust created in section 12 of Senate Bill     is exempt from

15  the provisions of section 119.07(1), Florida Statutes, and

16  Section 24(a) of Article I of the State Constitution, and the

17  anonymity of donors must be maintained in the auditor's

18  report. Information received by the organization that is

19  otherwise confidential or exempt by law shall retain that

20  status. Any sensitive, personal information regarding contract

21  beneficiaries, including their identities, is exempt from the

22  provisions of section 119.07(1), Florida Statutes, and Section

23  24(a) of Article I of the State Constitution. This exemption

24  is subject to the Open Government Sunset Review Act in

25  accordance with section 119.15, Florida Statutes, and expires

26  on October 2, 2004, unless reviewed and reenacted by the

27  Legislature.

28         Section 2.  The Legislature finds that it is a public

29  necessity that the donor records of the direct-support

30  organization for the Florida Affordable College Trust be held

31  confidential in order to encourage donations to direct-support

  1  organizations. Furthermore, the Legislature finds that it

  2  would be an invasion of privacy for sensitive records relating

  3  to donors and their beneficiaries to be revealed to the

  4  public.

  5         Section 3.  This act shall take effect on the effective

  6  date of SB     or similar legislation relating to the

  7  direct-support organization for the Florida Affordable College

  8  Trust.
