  1                      A bill to be entitled

  2         An act relating to water and wastewater

  3         utilities; amending s. 367.091, F.S.; requiring

  4         utilities to notify local governing bodies of

  5         the filing of an application for rate change;

  6         requiring the Florida Public Service Commission

  7         to grant petitions to intervene which are filed

  8         by local governing bodies; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Present subsections (2), (3), (4), and (5)

14  of section 367.091, Florida Statutes, are redesignated as

15  subsections (3), (4), (5), and (6), respectively, and a new

16  subsection (2) is added to that section, to read:

17         367.091  Rates, tariffs; new class of service.--

18         (2)  Upon filing an application for new rates, the

19  utility shall mail a copy of the application to the chief

20  executive officer of the governing body of each county within

21  the service areas included in the rate request. The governing

22  body may petition the commission for leave to intervene in the

23  rate change proceeding and the commission shall grant

24  intervenor status to any governing body that files a petition.

25         Section 2.  This act shall take effect July 1, 1999.

                       COMMITTEE SUBSTITUTE FOR
  2                              SB 926

  4  Requires any water and wastewater utility filing an
    application for a rate change with the Florida Public Service
  5  Commission to notify the governing body of every county in the
    utility's service area affected by the requested rate change
  6  of the application.

  7  Directs the Florida Public Service Commission to grant
    intervenor status to the governing body of any county affected
  8  by a water and wastewater rate proceeding that files a
    petition to intervene in the proceeding.
