  1                      A bill to be entitled

  2         An act relating to the Florida Safety Belt Law;

  3         amending s. 316.614, F.S.; revising the Florida

  4         Safety Belt Law to eliminate the requirement

  5         that the law be enforced as a secondary action

  6         when a driver of a motor vehicle has been

  7         detained for another violation; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (8) of section 316.614, Florida

13  Statutes, is amended to read:

14         316.614  Safety belt usage.--

15         (8)  Any person who violates the provisions of this

16  section commits a nonmoving violation, punishable as provided

17  in chapter 318. However, enforcement of this section by state

18  or local law enforcement agencies must be accomplished only as

19  a secondary action when a driver of a motor vehicle has been

20  detained for a suspected violation of another section of this

21  chapter, chapter 320, or chapter 322.

22         Section 2.  This act shall take effect July 1, 1999.
