1 A bill to be entitled
2 An act relating to public swimming and bathing
3 facilities; amending s. 514.011, F.S.;
4 redefining the term "public swimming pool" or
5 "public pool"; amending s. 514.0115, F.S.;
6 exempting from supervision or regulation as a
7 public pool any pool serving a residential
8 child care facility if the pool is for the
9 exclusive use of the facility's residents and
10 not open to the public; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (2) of section 514.011, Florida
16 Statutes, 1998 Supplement, is amended to read:
17 514.011 Definitions.--As used in this chapter:
18 (2) "Public swimming pool" or "public pool" means a
19 watertight structure of concrete, masonry, or other approved
20 materials which is located either indoors or outdoors, used
21 for bathing or swimming by humans, and filled with a filtered
22 and disinfected water supply, together with buildings,
23 appurtenances, and equipment used in connection therewith. A
24 public swimming pool or public pool shall mean a conventional
25 pool, spa-type pool, wading pool, special purpose pool, or
26 water recreation attraction, to which admission may be gained
27 with or without payment of a fee and includes, but is not
28 limited to, pools operated by or serving camps, churches,
29 cities, counties, day care centers, group home facilities for
30 eight or more clients, health spas, institutions, parks, state
31 agencies, schools, subdivisions, or the cooperative

1 living-type projects of five or more living units, such as
2 apartments, boardinghouses, hotels, mobile home parks, motels,
3 recreational vehicle parks, and townhouses. However, a pool
4 serving a residential child care facility is not a public
5 swimming pool or public pool if it is for the exclusive use of
6 the facility's residents and not open to the public.
7 Section 2. Subsection (4) of section 514.0115, Florida
8 Statutes, 1998 Supplement, is renumbered as subsection (5),
9 and a new subsection (4) is added to said section to read:
10 514.0115 Exemptions from supervision or regulation;
11 variances.--
12 (4) Any pool serving a residential child care facility
13 shall be exempt from supervision or regulation under this
14 chapter if the pool is for the exclusive use of the facility's
15 residents and not open to the public.
16 Section 3. This act shall take effect upon becoming a
17 law.
