  1                      A bill to be entitled

  2         An act related to public swimming pool

  3         construction standards for certain residential

  4         child care facilities; amending s. 514.0115,

  5         F.S.; exempting from supervision or regulation

  6         related to construction standards any

  7         residential child care facility registered and

  8         exempt from licensure pursuant to s. 409.176,

  9         F.S.; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (4) of section 514.0115, Florida

14  Statutes, 1998 Supplement, is renumbered as subsection (5),

15  and a new subsection (4) is added to said section to read:

16         (4)  Any pool serving a residential child care agency

17  registered and exempt from licensure pursuant to s. 409.176

18  shall be exempt from supervision or regulation under this

19  chapter related to construction standards if the pool is used

20  exclusively by the facility's residents and if admission may

21  not be gained by the public.

22         Section 2.  This act shall take effect upon becoming a

23  law.
