8 public education, training, prevention, and
9 treatment; amending s. 24.105, F.S.; requiring
10 the Department of the Lottery to require
11 vendors to provide notice of a toll-free
12 problem gambling hotline; requiring lottery
13 personnel and vendors to receive certain
14 training and education; amending s. 24.112,
15 F.S.; requiring retailers of lottery tickets to
16 provide notice of a toll-free problem gambling
17 hotline; amending s. 550.054, F.S.; requiring
18 pari-mutuel licensees to provide notice of a
19 toll-free problem gambling hotline; amending s.
20 849.0931, F.S.; requiring authorized bingo
21 organizations to provide notice of a toll-free
22 problem gambling hotline; providing
23 appropriations; providing an effective date.

25 Be It Enacted by the Legislature of the State of Florida:
26
27 Section 1. Compulsive gambling program.--Within
28 resources specifically appropriated for this purpose and
29 consistent with s. 20.19(17), the Alcohol, Drug Abuse, and
30 Mental Health Program Office within the Department of Children
31 and Family Services shall establish a program for public

1 education, awareness, and training regarding problem and
2 compulsive gambling and the treatment and prevention of
3 problem and compulsive gambling. The program shall include:
4 (1) Maintenance of a compulsive gambling advocacy
5 organization's toll-free problem gambling telephone number to
6 provide crisis counseling and referral services to families
7 experiencing difficulty as a result of problem or compulsive
8 gambling.
9 (2) The promotion of public awareness regarding the
10 recognition and prevention of problem or compulsive gambling.
11 (3) Facilitation, through inservice training and other
12 means, of the availability of effective assistance programs
13 for problem and compulsive gamblers, of all ages, and family
14 members affected by problem and compulsive gambling.
15 (4) Studies to identify adults and juveniles in this
16 state who are, or who are at risk of becoming, problem or
17 compulsive gamblers.
18 Section 2. Subsections (22) and (23) are added to
19 section 24.105, Florida Statutes, 1998 Supplement, to read:
20 24.105 Powers and duties of department.--The
21 department shall:
22 (22) Print the statement and the toll-free number
23 provided by the Alcohol, Drug Abuse, and Mental Health Program
24 Office within the Department of Children and Family Services
25 "IF YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS
26 AVAILABLE. CALL (the number provided)." on all lottery
27 tickets, advertising, and marketing materials provided to the
28 general public and shall include this requirement in all
29 contracts entered into with vendors pursuant to s. 24.111.
30 (23) Require all appropriate department personnel and
31 vendors as determined by the department to receive training

1 and education on problem and compulsive gambling, such
2 training and education to be provided by an advocacy
3 organization for problem and compulsive gambling to be
4 selected by the Alcohol, Drug Abuse, and Mental Health Program
5 Office within the Department of Children and Family Services.
6 Section 3. Subsection (6) of section 24.112, Florida
7 Statutes, is amended to read:
8 24.112 Retailers of lottery tickets.--
9 (6) Every retailer shall post and keep conspicuously
10 displayed in a location on the premises accessible to the
11 public its certificate of authority and, with respect to each
12 game, a statement supplied by the department of the estimated
13 odds of winning some prize for the game. Every retailer shall
14 also post and keep conspicuously displayed in a location on
15 the premises accessible to the public the statement "IF YOU OR
16 SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE.
17 CALL (the number provided)." and shall print this statement
18 and the toll-free number provided by the Alcohol, Drug Abuse,
19 and Mental Health Program Office within the Department of
20 Children and Family Services on all advertising and marketing
21 materials provided or conducted by the licensee on all lottery
22 tickets.
23 Section 4. Subsections (14) and (15) are added to
24 section 550.054, Florida Statutes, to read:
25 550.054 Application for permit to conduct pari-mutuel
26 wagering.--
27 (14) Each pari-mutuel facility licensee shall post
28 signs with the statement and the toll-free number provided by
29 the Alcohol, Drug Abuse, and Mental Health Program Office
30 within the Department of Children and Family Services "IF YOU

1 CALL (the number provided)." Such signs shall be posted within
2 50 feet of each entrance and exit and within 50 feet of each
3 credit location within the pari-mutuel facility. Such signs
4 shall also be posted within 50 feet of any facility at which
5 an intertrack wager may be placed.
6 (15) Each pari-mutuel facility licensee shall print
7 the statement and the toll-free number provided by the
8 Alcohol, Drug Abuse, and Mental Health Program Office within
9 the Department of Children and Family Services "IF YOU OR
10 SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE.
11 CALL (the number provided)." on all advertising and marketing
12 materials provided or conducted by the licensee or its lessees
13 to the general public.
14 Section 5. Present subsection (13) of section
15 849.0931, Florida Statutes, is renumbered as subsection (15),
16 and new subsections (13) and (14) are added to that section,
17 to read:
18 849.0931 Bingo authorized; conditions for conduct;
19 permitted uses of proceeds; limitations.--
20 (13) Each organization conducting bingo open to the
21 public shall post signs with the statement and the toll-free
22 number provided by the Alcohol, Drug Abuse, and Mental Health
23 Program Office within the Department of Children and Family
24 Services "IF YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM,
25 HELP IS AVAILABLE. CALL (the number provided)." Such signs
26 shall be posted within 50 feet of each entrance and exit to
27 the premises at which bingo is conducted by the organization.
28 (14) Each organization conducting bingo open to the
29 public shall print the statement and the toll-free number
30 provided by the Alcohol, Drug Abuse, and Mental Health Program
31 Office within the Department of Children and Family Services

1 "IF YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS
2 AVAILABLE. CALL (the number provided)." on all advertising and
3 marketing materials provided or conducted by the licensee.
4 (15)(13) Any organization or other person who
5 willfully and knowingly violates any provision of subsections
6 (1)-(12) commits this section is guilty of a misdemeanor of
7 the first degree, punishable as provided in s. 775.082 or s.
8 775.083. For a second or subsequent offense, the organization
9 or other person commits is guilty of a felony of the third
10 degree, punishable as provided in s. 775.082, s. 775.083, or
11 s. 775.084.
12 Section 6. Appropriations.--
13 (1) The amount of $500,000 is appropriated from the
14 General Revenue Fund to the Alcohol, Drug Abuse, and Mental
15 Health Program Office within the Department of Children and
16 Family Services to establish a dedicated, nonreverting fund
17 for distribution to an advocacy organization for problem and
18 compulsive gambling to maintain the toll-free statewide
19 problem gambling referral hotline, promote public awareness,
20 and conduct inservice training concerning problem and
21 compulsive gambling in cooperation with the program office, as
22 required by section 1 of this act.
23 (2) The amount of $2 million is appropriated from the
24 General Revenue Fund to the Alcohol, Drug Abuse, and Mental
25 Health Program Office within the Department of Children and
26 Family Services to establish a dedicated, nonreverting fund to
27 conduct treatment programs for problem and compulsive
28 gamblers.
29 (3) The Division of Pari-Mutuel Wagering within the
30 Department of Business and Professional Regulation is
31 authorized to expend up to $250,000 from the Pari-Mutuel

1 Wagering Trust Fund for education, awareness, prevention, and
2 treatment programs for problem and compulsive gamblers.
3 Section 7. This act shall take effect July 1, 1999.

5 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
6 Senate Bill 962

8 Specifies that the compulsive gambling program must be
implemented with resources specifically appropriated for this
9 purpose.
10 Specifies that the Alcohol, Drug Abuse, and Mental Health
Program Office will use the provisions in s. 20.19(17), F.S.,
11 1998 Supp., to select the advocacy organization that will
operate the toll-free telephone number for the crisis
12 counseling and referral service.
13 Specifies that the Alcohol, Drug Abuse and Mental Health
Program Office will provide the toll free number for public
14 display to the Department of the Lottery, the Department of
Business and Professional Regulation, and organizations that
15 conduct bingo.
