1 A bill to be entitled
2 An act relating to compulsive gambling;
3 directing the Alcohol, Drug Abuse, and Mental
4 Health Program Office within the Department of
5 Children and Family Services to establish
6 within resources specifically appropriated and
7 pursuant to s. 20.19(17), F.S., a program for
8 public education, training, prevention, and
9 treatment; amending s. 24.105, F.S.; requiring
10 lottery personnel and lottery retailers to
11 receive certain education; amending s. 24.112,
12 F.S.; requiring retailers of lottery tickets to
13 provide notice of a toll-free problem gambling
14 hotline; amending s. 550.054, F.S.; requiring
15 pari-mutuel permitholders to provide notice of
16 a toll-free problem gambling hotline; amending
17 s. 849.0931, F.S.; requiring authorized bingo
18 organizations to provide notice of a toll-free
19 problem gambling hotline; providing an
20 effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Compulsive gambling program.--Within
25 resources specifically appropriated for this purpose and
26 consistent with s. 20.19(17), the Alcohol, Drug Abuse, and
27 Mental Health Program Office within the Department of Children
28 and Family Services shall establish a program for public
29 education, awareness, and training regarding problem and
30 compulsive gambling and the treatment and prevention of
31 problem and compulsive gambling. The program shall include:

1 (1) Maintenance of a compulsive gambling advocacy
2 organization's toll-free problem gambling telephone number to
3 provide crisis counseling and referral services to families
4 experiencing difficulty as a result of problem or compulsive
5 gambling.
6 (2) The promotion of public awareness regarding the
7 recognition and prevention of problem or compulsive gambling.
8 (3) Facilitation, through inservice training and other
9 means, of the availability of effective assistance programs
10 for problem and compulsive gamblers, of all ages, and family
11 members affected by problem and compulsive gambling.
12 (4) Studies to identify adults and juveniles in this
13 state who are, or who are at risk of becoming, problem or
14 compulsive gamblers.
15 Section 2. Subsection (22) is added to section 24.105,
16 Florida Statutes, 1998 Supplement, to read:
17 24.105 Powers and duties of department.--The
18 department shall:
19 (22) Require appropriate department personnel and
20 lottery retailers, as determined by the department, to receive
21 education on problem and compulsive gambling provided by an
22 advocacy organization for problem and compulsive gambling to
23 be selected by the Alcohol, Drug Abuse, and Mental Health
24 Program Office within the Department of Children and Family
25 Services.
26 Section 3. Subsection (6) of section 24.112, Florida
27 Statutes, is amended to read:
28 24.112 Retailers of lottery tickets.--
29 (6) Every retailer shall post and keep conspicuously
30 displayed in a location on the premises accessible to the
31 public its certificate of authority and, with respect to each

1 game, a statement supplied by the department of the estimated
2 odds of winning some prize for the game. Every retailer shall
3 also post at least one sign with the statement "IF YOU OR
4 SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE.
5 CALL (the toll-free number provided by the Alcohol, Drug
6 Abuse, and Mental Health Program Office within the Department
7 of Children and Family Services)." Such signs must be posted
8 and conspicuously displayed in a location near the lottery
9 play station or check-out counter where instant or on-line
10 lottery tickets are purchased.
11 Section 4. Subsections (14) and (15) are added to
12 section 550.054, Florida Statutes, to read:
13 550.054 Application for permit to conduct pari-mutuel
14 wagering.--
15 (14) Each pari-mutuel permitholder shall post signs
16 with the statement and the toll-free number provided by the
17 Alcohol, Drug Abuse, and Mental Health Program Office within
18 the Department of Children and Family Services "IF YOU OR
19 SOMEONE YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE.
20 CALL (the toll-free number provided by the Alcohol, Drug
21 Abuse, and Mental Health Program Office within the Department
22 of Children and Family Services)." Such signs shall be posted
23 within 50 feet of each entrance commonly used for access by
24 the public and within 50 feet of each credit location within
25 the pari-mutuel facility.
26 (15) Each pari-mutuel permitholder shall print the
27 statement and the toll-free number provided by the Alcohol,
28 Drug Abuse, and Mental Health Program Office within the
29 Department of Children and Family Services "IF YOU OR SOMEONE
30 YOU KNOW HAS A GAMBLING PROBLEM, HELP IS AVAILABLE. CALL (the
31 toll-free number provided by the Alcohol, Drug Abuse, and

1 Mental Health Program Office within the Department of Children
2 and Family Services)" on all daily racing programs provided by
3 the permitholder or its lessees to the public.
4 Section 5. Present subsection (13) of section
5 849.0931, Florida Statutes, is amended and renumbered as
6 subsection (14), and a new subsection (13) is added to that
7 section, to read:
8 849.0931 Bingo authorized; conditions for conduct;
9 permitted uses of proceeds; limitations.--
10 (13) Each organization conducting bingo open to the
11 public shall post signs with the statement and the toll-free
12 number provided by the Alcohol, Drug Abuse, and Mental Health
13 Program Office within the Department of Children and Family
14 Services "IF YOU OR SOMEONE YOU KNOW HAS A GAMBLING PROBLEM,
15 HELP IS AVAILABLE. CALL (the toll-free number provided by the
16 Alcohol, Drug Abuse, and Mental Health Program Office within
17 the Department of Children and Family Services)." Such signs
18 shall be posted within 50 feet of each entrance commonly used
19 for access by the public to the premises at which bingo is
20 conducted by the organization.
21 (14)(13) Any organization or other person who
22 willfully and knowingly violates any provision of subsections
23 (1)-(12) commits this section is guilty of a misdemeanor of
24 the first degree, punishable as provided in s. 775.082 or s.
25 775.083. For a second or subsequent offense, the organization
26 or other person commits is guilty of a felony of the third
27 degree, punishable as provided in s. 775.082, s. 775.083, or
28 s. 775.084.
29 Section 6. This act shall take effect July 1, 1999.

4 Removes the requirement that the Department of the Lottery
print a notice of a toll-free problem gambling telephone
5 number on all lottery tickets, advertising, and marketing
materials provided to the general public.

Removes the requirement that lottery retailers, pari-mutuel
7 permitholders, and organizations conducting bingo open to the
public print a statement and a toll-free problem gambling
8 phone number on all advertising and marketing materials
provided to the general public.

Reduces the number of signs containing the statement and
10 toll-free problem gambling phone number to be posted by
pari-mutuel permitholders and organizations conducting bingo
11 open to the public to require posting of signs a tall
entrances commonly used by the general public and at each
12 credit location within a pari-mutuel facility.
13 Removes the appropriation of $2.5 million from General Revenue
to establish a nonreverting fund to conduct treatment
14 programs, and the authorization for the Division of
Pari-mutuel Wagering to expend up to $250,000 from the
15 Pari-mutuel Wagering Trust Fund for education and treatment
programs for problem and compulsive gamblers.
