11  Senator Campbell moved the following amendment:

13         Senate Amendment (with title amendment) 

14          Delete everything after the enacting clause

15

16  and insert:

17         Section 1.  Subsection (2) of section 893.138, Florida

18  Statutes, 1998 Supplement, is amended to read:

19         893.138  Local administrative action to abate

20  drug-related or prostitution-related public nuisances and

21  criminal street gang activity.--

22         (2)  Any place or premises that has been used on more

23  than two occasions, within a 6-month period:

24         (a)  On more than two occasions within a 6-month

25  period, as the site of a violation of s. 796.07;

26         (b)  On more than two occasions within a 6-month

27  period, as the site of the unlawful sale, delivery,

28  manufacture, or cultivation of any controlled substance;

29         (c)  On one occasion as the site of the unlawful

30  possession of a controlled substance, where such possession

31  constitutes a felony and that has been previously used on more

 1  than one occasion as the site of the unlawful sale, delivery,

 2  manufacture, or cultivation of any controlled substance; or

 3         (d)  Any place or building used By a criminal street

 4  gang for the purpose of conducting a pattern of criminal

 5  street gang activity as defined by s. 874.03; or

 6         (e)  On more than two occasions within a 6-month

 7  period, as the site of a violation of s. 812.019 relating to

 8  dealing in stolen property

 9

10  may be declared to be a public nuisance, and such nuisance may

11  be abated pursuant to the procedures provided in this section.

12         Section 2.  This act shall take effect July 1, 1999.

20                      A bill to be entitled

21         An act relating to local governments; amending

22         s. 893.138, F.S.; authorizing local governments

23         to take local administrative action to declare

24         certain buildings and premises a public

25         nuisance when the building or premises is used

26         on more than two occasions in a certain time

27         period to deal in stolen property; providing an

28         effective date.
