1 A bill to be entitled
2 An act relating to county government; amending
3 s. 125.61, F.S.; revising requirements relating
4 to the number of members of a charter
5 commission and the method of appointment of
6 such members; specifying additional persons who
7 may not serve on a charter commission;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsection (2) of section 125.61, Florida
13 Statutes, is amended to read:
14 125.61 Charter commission.--
15 (2) The charter commission or appointed charter review
16 commission shall be composed of an odd number of not less than
17 11 or more than 15 members. The members of the commission or
18 the review commission shall be appointed as follows, unless
19 the review commission is elected pursuant to the provisions of
20 the local charter: by
21 (a) The board of county commissioners of said county
22 shall appoint 10 members.
23 (b) If elected, the clerk of the circuit court, tax
24 collector, property appraiser, supervisor of elections, and
25 sheriff shall each appoint 1 member. If any of these officers
26 is appointed or if the office does not exist, the board of
27 county commissioners shall make the appointment that would
28 otherwise be made by that officer.
29 (c) Notwithstanding the provisions of this subsection
30 to the contrary, in a county with a population over 800,000, a
31 charter commission or appointed charter review commission may

1 be composed of 20 members. All members shall be appointed by
2 the board of county commissioners, except that the clerk of
3 the circuit court, tax collector, property appraiser,
4 supervisor of elections, and sheriff shall, if elected,
5 appoint 1 member.
6 (d) or, If so directed in the initiative petition, in
7 lieu of the appointments provided for in paragraphs (a) and
8 (b), all charter commission members shall be appointed by the
9 legislative delegation.

11 No member of the Legislature, no employee of such member or of
12 the legislative delegation, no member of the or board of
13 county commissioners, no employee of the board, no elected
14 county constitutional officer, and no employee of any such
15 officer shall be a member of the charter commission.
16 Vacancies shall be filled within 30 days in the same manner as
17 the original appointments.
18 Section 2. This act shall take effect upon becoming a
19 law.

24 CS for SB 984 differs from the bill in the following ways:
25 Clarifies language related to appointed or elected charter
commissions;
26
Removes specific references to Miami-Dade County; and
27
Allows charter commissions in counties with a population of
28 more than 800,000 to be composed of 20, rather than 15,
members.
