2 An act relating to public records and meetings;
3 providing an exemption from public records and
4 meetings requirements for the blueprints of an
5 educational facility, including a state
6 university facility; providing for future
7 legislative review and repeal; providing for
8 rulemaking authority; providing a finding of
9 public necessity; providing a contingent
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. (1) Each blueprint of an educational
15 facility as defined in section 235.011(6), Florida Statutes,
16 and each blueprint of a state university facility that is
17 submitted to a law enforcement agency, the Department of
18 Education, or the State Board of Education, as required by
19 Committee Substitute for Senate Bills 852, 2, and 46, 2000
20 Regular Session, is confidential and exempt from section
21 119.07(1), Florida Statutes, and Section 24(a), Article I of
22 the State Constitution. This exemption is subject to the Open
23 Government Sunset Review Act of 1995 in accordance with
24 section 119.15, Florida Statutes, and shall stand repealed on
25 October 2, 2005, unless reviewed and saved from repeal through
26 reenactment by the Legislature.
27 (2) Portions of all meetings or proceedings of any
28 agency as defined in section 119.011(2), Florida Statutes,
29 relating directly to, or that would reveal confidential and
30 exempt information relating solely to, the blueprints of an
31 educational facility or of a state university facility are

1 confidential and exempt from section 286.011, Florida
2 Statutes, and Section 24(b), Article I of the State
3 Constitution. An agency as defined in section 119.011(2),
4 Florida Statutes, may hold public meetings to discuss
5 nonconfidential information or issues relating to these
6 blueprints.
7 (3) The Department of Education shall prescribe by
8 rule the information relating to the blueprints of an
9 educational facility, as defined in section 235.011(6),
10 Florida Statutes, which is confidential and exempt from the
11 provisions of section 119.07(1), Florida Statutes, and Section
12 24(a), Article I of the State Constitution. To be
13 confidential, the information must be necessary to the
14 security and integrity of the educational facility.
15 (4) The Board of Regents shall prescribe by rule the
16 information relating to the blueprints of a state university
17 facility which is confidential and exempt from the provisions
18 of section 119.07(1), Florida Statutes, and Section 24(a),
19 Article I of the State Constitution. To be confidential, the
20 information must be necessary to the security and integrity of
21 the state university facility.
22 (5) Confidential and exempt information may be
23 released to and used by other governmental entities as needed
24 in connection with the performance of their duties. Any such
25 information that is confidential and exempt as provided for in
26 this section retains its status as confidential and exempt.
27 Section 2. The Legislature finds that the exemption
28 from the public records law provided in section 1 of this act
29 is a public necessity and that the protection of students and
30 others in schools, community colleges, and universities is a
31 critical state concern. Furthermore, the Legislature finds

1 that failure to protect the confidentiality of a blueprint of
2 an educational facility or a state university facility
3 submitted to or collected by law enforcement personnel, the
4 Department of Education, or the State Board of Education under
5 section of Committee Substitute for Senate Bills 852, 2,
6 and 46, 2000 Regular Session, would impede the safety and
7 security of schools, community colleges, universities,
8 students, and others.
9 Section 3. This act shall take effect on the effective
10 date of Committee Substitute for Senate Bills 852, 2, and 46,
11 2000 Regular Session, or similar legislation relating to
12 educational and state university facilities, and shall not
13 take effect if that legislation does not become law.
