  1                      A bill to be entitled

  2         An act relating to voter registration;

  3         repealing s. 97.056, F.S., relating to

  4         in-person voting requirements for certain

  5         persons who register by mail; amending s.

  6         97.071, F.S.; deleting procedures for mailing

  7         voter registration identification cards;

  8         amending s. 97.1031, F.S.; revising cross

  9         references, to conform; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 97.056, Florida Statutes, is

15  repealed.

16         Section 2.  Section 97.071, Florida Statutes, is

17  amended to read:

18         97.071  Registration identification card.--

19         (1)  A registration identification card must be

20  furnished to all voters registering under the permanent single

21  registration system and must contain:

22         (a)  Voter's registration number.

23         (b)  Date of registration.

24         (c)  Full name.

25         (d)  Party affiliation.

26         (e)  Date of birth.

27         (f)  Race or ethnicity, if provided by the applicant.

28         (g)  Sex, if provided by the applicant.

29         (h)  Address of legal residence.

30         (i)  Precinct number.

31         (j)  Signature of supervisor.

  1         (k)  Place for voter's signature.

  2         (l)  Other information deemed necessary by the

  3  department.

  4         (2)(a)  Except as provided in paragraph (b), the

  5  supervisor of elections shall mail a registration

  6  identification card to the voter at the address listed as the

  7  legal residence on the voter's registration application. The

  8  card must be sent by nonforwardable, return-if-undeliverable

  9  mail.  If the identification card is returned as undeliverable

10  and the voter has indicated a different mailing address on the

11  registration application, the supervisor must mail a notice to

12  the mailing address, notifying the voter that his or her

13  registration identification card was returned and that the

14  voter may appear in person at the supervisor's office to pick

15  up the identification card.  The supervisor must surrender the

16  identification card to the elector upon presentation of a

17  Florida driver's license, a Florida identification card issued

18  under s. 322.051, or another form of picture identification

19  approved by the Department of State.  If the elector fails to

20  furnish the required identification, or if the supervisor has

21  doubts as to the identity of the elector, the supervisor must

22  require the elector to swear an oath substantially similar to

23  the one prescribed in s. 101.49 prior to surrendering the

24  identification card.  The supervisor must keep the

25  identification card on file for 45 days following return of

26  the card as undeliverable.

27         (b)  The supervisor shall mail the voter identification

28  card by forwardable mail to voters who are covered by the

29  Uniformed and Overseas Citizens Absentee Voting Act.

30         (2)(3)  A voter may receive a replacement of a

31  registration identification card by providing a signed,

  1  written request for a replacement card to the supervisor. Upon

  2  verification of registration, the supervisor shall issue the

  3  voter a duplicate card without charge.

  4         (3)(4)  In the case of a change of name, address, or

  5  party affiliation, the supervisor must issue the voter a new

  6  registration identification card. However, a registration

  7  identification card indicating a party affiliation change made

  8  between the book-closing date for the first primary election

  9  and the date of the second primary election may not be issued

10  until after the second primary election.

11         Section 3.  Subsections (3) and (4) of section 97.1031,

12  Florida Statutes, are amended to read:

13         97.1031  Notice of change of residence within the same

14  county, change of name, or change of party.--

15         (3)  When an elector seeks to change party affiliation,

16  the elector must provide a signed, written notification of

17  such intent to the supervisor and obtain a registration

18  identification card reflecting the new party affiliation,

19  subject to the issuance restriction in s. 97.071(3)(4).

20         (4)  The supervisor shall make the necessary changes in

21  the elector's records as soon as practical upon receipt of

22  such notice of a change of address of legal residence, name,

23  or party affiliation and shall issue the new registration

24  identification card as required by s. 97.071(3)(4).

25         Section 4.  This act shall take effect July 1, 2000.

      Repeals in-person voting requirements for persons who
30    have registered by mail but haven't previously voted in
      the county in which registered. Deletes procedures for
31    mailing voter registration identification cards.
