11  Senator Diaz de la Portilla moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 9 between lines 29 and 30,

15

16  insert:

17         Section 3.  Subsection (5) of section 310.151, Florida

18  Statutes, is amended to read:

19         310.151  Rates of pilotage; Pilotage Rate Review

20  Board.--

21         (5)(a)  In determining whether the requested rate

22  change will result in fair, just, and reasonable rates, the

23  board shall give primary consideration to the public interest

24  in promoting and maintaining efficient, reliable, and safe

25  piloting services. The board shall also give consideration to

26  the economic impact of total pilotage costs on the costs of

27  shipping in Florida.

28         (b)  The board shall also give consideration to the

29  following factors:

30         1.  The public interest in having qualified pilots

31  available to respond promptly to vessels needing their

 1  service.

 2         2.  A determination of the average net income of pilots

 3  in the port, including the value of all benefits derived from

 4  service as a pilot. For the purposes of this subparagraph,

 5  "net income of pilots" refers to total pilotage fees collected

 6  in the port, minus reasonable operating expenses, divided by

 7  the number of licensed and active state pilots within the

 8  ports.

 9         3.  Reasonable operating expenses of pilots.

10         4.  Pilotage rates in other ports.

11         5.  The amount of time each pilot spends on actual

12  piloting duty and the amount of time spent on other essential

13  support services.

14         6.  The prevailing compensation available to

15  individuals in other maritime services of comparable

16  professional skill and standing as that sought in pilots, it

17  being recognized that in order to attract to the profession of

18  piloting, and to hold the best and most qualified individuals

19  as pilots, the overall compensation accorded pilots should be

20  equal to or greater than that available to such individuals in

21  comparable maritime employment.

22         7.  The impact rate change may have in individual pilot

23  compensation and whether such change will lead to a shortage

24  of licensed state pilots, certificated deputy pilots, or

25  qualified pilot applicants.

26         8.  Projected changes in vessel traffic, including

27  whether the impact rate change may reduce the number of

28  vessels at the particular port.

29         9.  Cost of retirement and medical plans.

30         10.  Physical risks inherent in piloting.

31         11.  Special characteristics, dangers, and risks of the

 1  particular port.

 2         12.  The rate of return based on the rate change.

 3         13.  The total cost of pilotage on the cost of shipping

 4  at the particular port compared to the costs at other Florida

 5  ports and other states.

 6         14.12.  Any other factors the board deems relevant in

 7  determining a just and reasonable rate.

 8         (c)  The board may take into consideration the consumer

 9  price index or any other comparable economic indicator when

10  fixing rates of pilotage; however, because the consumer price

11  index or such other comparable economic indicator is primarily

12  related to net income rather than rates, the board shall not

13  use it as the sole factor in fixing rates of pilotage.
