  1                      A bill to be entitled

  2         An act relating to firearms; defining the term

  3         "fingerprint-resistant gun"; providing that it

  4         is a felony of the third degree to manufacture,

  5         sell, or deliver any fingerprint-resistant gun;

  6         authorizing a law enforcement agency or law

  7         enforcement officer to possess a

  8         fingerprint-resistant gun; authorizing the

  9         manufacture, sale, or delivery of a

10         fingerprint-resistant gun for use by a law

11         enforcement agency; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  (1)  As used in this section, the term

17  "fingerprint-resistant gun" means a firearm that is

18  manufactured from a material that resists fingerprints, or

19  that has a surface coating that resists fingerprints, so that

20  a law enforcement agency is substantially prevented from

21  identifying the holder of the gun by use of fingerprinting.

22         (2)  Any person who manufactures, sells, offers for

23  sale, or delivers any fingerprint-resistant gun commits a

24  felony of the third degree, punishable as provided in section

25  775.082, section 775.083, or section 775.084, Florida

26  Statutes.

27         (3)  This section does not apply to:

28         (a)  The possession of a fingerprint-resistant gun by a

29  law enforcement agency or by any law enforcement officer in

30  the performance of his or her duties as a law enforcement

31  officer.

  1         (b) The manufacture of a fingerprint-resistant gun

  2  exclusively for the purpose of sale or delivery to a law

  3  enforcement agency.

  4         (c)  The sale or delivery of a fingerprint-resistant

  5  gun to a law enforcement agency.

  6         Section 2.  This act shall take effect October 1, 2000.

  9                          SENATE SUMMARY

10    Provides that it is a third-degree felony to manufacture,
      sell, or deliver a fingerprint-resistant gun. Defines the
11    term "fingerprint-resistant gun" to mean a firearm that
      is made from a material or that has a coating that
12    resists fingerprints. Provides that a law enforcement
      agency or law enforcement officer may possess a
13    fingerprint-resistant gun. Authorizes the manufacture,
      sale, or delivery of a fingerprint-resistant gun for use
14    by a law enforcement agency.
