14         On page 30, between lines 18 and 19,

16  insert:

17         Section 10.  Subsection (1) of section 457.102, Florida

18  Statutes, is amended to read:

19         457.102  Definitions.--As used in this chapter:

20         (1)  "Acupuncture" means a form of primary health care,

21  based on traditional Chinese medical concepts and modern

22  oriental medical techniques, that employs acupuncture

23  diagnosis and treatment, as well as adjunctive therapies and

24  diagnostic techniques, for the promotion, maintenance, and

25  restoration of health and the prevention of disease.

26  Acupuncture shall include, but not be limited to, the

27  insertion of acupuncture needles and the application of

28  moxibustion to specific areas of the human body, the use of

29  electroacupuncture, Qi Gong, oriental massage, herbal therapy,

30  dietary guidelines, and other adjunctive therapies, as defined

31  by board rule.

 1         Section 11.  Subsection (2) of section 457.105, Florida

 2  Statutes, is amended to read:

 3         457.105  Licensure qualifications and fees.--

 4         (2)  A person may become licensed to practice

 5  acupuncture if the person applies to the department and:

 6         (a)  Is 21 18 years of age or older, is of good moral

 7  character, and has the ability to communicate in English, as

 8  measured by having passed the national written examination in

 9  English or having passed an English proficiency examination,

10  such as TOEFL, TSE, or TOIC;

11         (b)  Has completed 60 college credits from an

12  accredited postsecondary institution as a prerequisite to

13  enrollment in an authorized 3-year course of study in

14  acupuncture and oriental medicine, and has completed a 3-year

15  course of study in acupuncture and oriental medicine, and

16  effective July 31, 2001, a 4-year course of study in

17  acupuncture and oriental medicine, which meets standards

18  established by the board by rule, which standards include, but

19  are not limited to, successful completion of academic courses

20  in western anatomy, western physiology, western pathology,

21  western biomedical terminology, first aid, and cardiopulmonary

22  resuscitation (CPR). However, any person who enrolled in an

23  authorized course of study in acupuncture before August 1,

24  1997, must have completed only a 2-year course of study which

25  meets standards established by the board by rule, which

26  standards must include, but are not limited to, successful

27  completion of academic courses in western anatomy, western

28  physiology, and western pathology;

29         (c)  Has successfully completed a board-approved

30  national certification process, is actively licensed in a

31  state that has examination requirements that are substantially

 1  equivalent to or more stringent than those of this state, or

 2  passes an examination administered by the department, which

 3  examination tests the applicant's competency and knowledge of

 4  the practice of acupuncture and Oriental medicine. At the

 5  request of any applicant, oriental nomenclature for the points

 6  shall be used in the examination. The examination shall

 7  include a practical examination of the knowledge and skills

 8  required to practice modern and traditional acupuncture and

 9  Oriental medicine, covering diagnostic and treatment

10  techniques and procedures; and

11         (d)  Pays the required fees set by the board by rule

12  not to exceed the following amounts:

13         1.  Examination fee: $500 plus the actual per applicant

14  cost to the department for purchase of the written and

15  practical portions of the examination from a national

16  organization approved by the board.

17         2.  Application fee: $300.

18         3.  Reexamination fee: $500 plus the actual per

19  applicant cost to the department for purchase of the written

20  and practical portions of the examination from a national

21  organization approved by the board.

22         4.  Initial biennial licensure fee: $400, if licensed

23  in the first half of the biennium, and $200, if licensed in

24  the second half of the biennium.

25         Section 12.  Subsection (1) of section 457.107, Florida

26  Statutes, is amended to read:

27         457.107  Renewal of licenses; continuing education.--

28         (1)  The department shall renew a license upon receipt

29  of the renewal application and the fee set by the board by

30  rule, not to exceed $500 $700.
