  1                      A bill to be entitled

  2         An act relating to plastic or cosmetic surgery;

  3         requiring certain advertisements for such

  4         surgery or procedures in an unlicensed setting

  5         to contain a warning relating to the potential

  6         dangers; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  In the text of any written advertisement

11  for plastic or cosmetic surgery or procedures that are

12  performed in a setting that is not licensed under chapter 395,

13  Florida Statutes, whether for surgery or procedures that are

14  deemed to be elective or medically necessary, the following

15  statement must appear in capital letters clearly

16  distinguishable from the rest of the text:  "AS WITH ANY

17  SURGERY, PLASTIC OR COSMETIC SURGERY CARRIES RISKS OF

18  UNINTENDED SERIOUS BODILY INJURY OR DEATH. CONSULT A LICENSED

19  PHYSICIAN CONCERNING THESE RISKS BEFORE SUBMITTING TO PLASTIC

20  OR COSMETIC SURGERY." Any advertisement that has an audible

21  component must orally contain this statement verbatim.

22         Section 2.  This act shall take effect upon becoming a

23  law.
