  1                      A bill to be entitled

  2         An act relating to animal cruelty; creating s.

  3         828.135, F.S.; prohibiting the tethering or

  4         confinement of a breeding sow or a calf raised

  5         for veal in specified living enclosures;

  6         providing exceptions; providing a penalty;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 828.135, Florida Statutes, is

12  created to read:

13         828.135  Tethering or confinement of breeding sow or

14  calf.--Any person who tethers or confines, or causes or

15  knowingly permits to be tethered or confined, a breeding sow

16  or a calf raised for veal, in a primary living enclosure that

17  prevents the sow or calf from standing up, lying down, or

18  turning around without any physical impediment commits a

19  misdemeanor of the first degree, punishable as provided in s.

20  775.082 or s. 775.083. This section shall not apply:

21         (1)  When a sow or calf is undergoing an examination,

22  test, treatment, or operation carried out for veterinary

23  purposes, provided the period during which the animal is

24  tethered or confined is not longer than necessary for the

25  stated purpose.

26         (2)  For purposes of confinement only, during the 7

27  days prior to a sow's expected date of giving birth and while

28  the sow is nursing her young.

29         Section 2.  This act shall take effect upon becoming a

30  law.
