  2         An act relating to nursing homes; amending s.
  3         400.235, F.S.; revising membership and terms of
  4         the Governor's Panel on Excellence in Long-Term
  5         Care; providing for selection of a panel
  6         chairperson; providing a definition; providing
  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:
10
11         Section 1.  Paragraph (a) of subsection (3) of section
12  400.235, Florida Statutes, is amended to read:
13         400.235  Nursing home quality and licensure status;
14  Gold Seal Program.--
15         (3)(a)1.  The Gold Seal Program shall be developed and
16  implemented by the Governor's Panel on Excellence in Long-Term
17  Care which shall operate under the authority of the Executive
18  Office of the Governor. For the purposes of staggering the
19  terms of the panel members and notwithstanding the conditions
20  of the original appointments, the terms of all panel members
21  shall expire on September 30, 2000. The panel shall be
22  composed of the following members appointed effective October
23  1, 2000: The panel shall be composed of three persons
24  appointed by the Governor, to include a consumer advocate for
25  senior citizens and two persons with expertise in the fields
26  of quality management, service delivery excellence, or public
27  sector accountability; three persons appointed by the
28  Secretary of Elderly Affairs, to include an active member of a
29  nursing facility family and resident care council and a member
30  of the University Consortium on Aging; the State Long-Term
31  Care Ombudsman; one person appointed by the Florida Life Care

  1  Residents Association; one person appointed by the Secretary
  2  of Health; two persons appointed by the Director of Health
  3  Care Administration, to include the Deputy Director for State
  4  Health Purchasing; one person appointed by the Florida
  5  Association of Homes for the Aging; and one person appointed
  6  by the Florida Health Care Association. All members of the
  7  panel shall be appointed by October 1, 1999, and the panel
  8  shall hold its organizational meeting no later than December
  9  10, 1999.
10         a.  A consumer advocate for senior citizens appointed
11  by the Governor, to serve a 4-year term.
12         b.  Two persons with expertise in the fields of quality
13  management, service delivery excellence, or public-sector
14  accountability appointed by the Governor, to serve 3-year
15  terms.
16         c.  A consumer advocate for senior citizens appointed
17  by the Secretary of Elderly Affairs, to serve a 4-year term.
18         d.  An active member of a nursing facility family and
19  resident care council appointed by the Secretary of Elderly
20  Affairs, to serve a 1-year term.
21         e.  A member of the University Consortium on Aging
22  appointed by the Secretary of Elderly Affairs, to serve a
23  2-year term.
24         f.  The State Long-Term Care Ombudsman, to serve an
25  indefinite term.
26         g.  A consumer advocate for senior citizens appointed
27  by the Florida Life Care Residents Association, to serve a
28  3-year term.
29         h.  A consumer advocate for senior citizens appointed
30  by the Secretary of Health, to serve a 2-year term.

  1         i.  A consumer advocate for senior citizens appointed
  2  by the Director of Health Care Administration, to serve a
  3  4-year term.
  4         j.  The Deputy Director for State Health Purchasing of
  5  the Agency for Health Care Administration, to serve an
  6  indefinite term.
  7         k.  One person appointed by the Florida Association of
  8  Homes for the Aging, to serve a 1-year term.
  9         l.  One person appointed by the Florida Health Care
10  Association, to serve a 2-year term.
11         m.  A member of the Florida Silver Hair Legislature
12  appointed by the Florida Silver Hair Legislature, to serve a
13  1-year term.
14         n.  A member of the Florida State Council of Senior
15  Citizens appointed by the Florida State Council of Senior
16  Citizens, to serve a 2-year term.

18  Thereafter, all panel members except those appointed under
19  subparagraphs f. and j. shall serve 4-year terms. Vacancies on
20  the panel shall be filled in the same manner as the original
21  appointments. No panel member shall be appointed to serve more
22  than two consecutive 4-year terms serve for more than 4
23  consecutive years from the date of appointment.
24         2.  Panel members shall select the panel chairperson by
25  a majority vote at the panel's first meeting after all panel
26  members have been appointed.
27         3.  For purposes of this paragraph, "consumer advocate
28  for senior citizens" means a person who:
29         a.  Receives no money from the nursing home industry in
30  the form of wages, contributions, or gifts and has no
31  relatives who receive such moneys;

  1         b.  Is not a state employee with the Agency for Health
  2  Care Administration, Department of Health, or Department of
  3  Elderly Affairs; and
  4         c.  Is either a member of an organized senior advocacy
  5  group or who has had or currently has a relative in a nursing
  6  home.
  7         Section 2.  This act shall take effect July 1, 2000.
