2 An act relating to the Florida Healthy Kids
3 program; amending s. 409.8134, F.S.; providing
4 enrollment and funding guidelines for the
5 Florida Healthy Kids program; providing an
6 effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsections (1) and (2) of section
11 409.8134, Florida Statutes, are amended to read:
12 409.8134 Program enrollment and expenditure
13 ceilings.--
14 (1) Except for the Medicaid program, a ceiling shall
15 be placed on annual federal and state expenditures and on
16 enrollment in the Florida Kidcare program as provided each
17 year in the General Appropriations Act. The agency, in
18 consultation with the Department of Health, may propose to
19 increase the enrollment ceiling in accordance with chapter
20 216. When such state funds have been exhausted, the Florida
21 Healthy Kids Corporation may accept funds in accordance with
22 Title XXI guidelines from local governments or entities in
23 order to enroll additional children so long as the local funds
24 meet the state's required matching share and federal funds are
25 available for matching purposes. It is the intent of the
26 Legislature to eliminate the local matching fund requirements
27 of the Florida Healthy Kids program, subject to an
28 appropriations act designed to compensate for the loss of
29 local matching funds. When funds are collected for this
30 purpose, the annual federal and state expenditure ceiling does
31 not apply towards this enrollment.

1 (2) Except for the Medicaid program, whenever the
2 Social Services Estimating Conference determines that there is
3 presently, or will be by the end of the current fiscal year,
4 insufficient funds to finance the current or projected
5 enrollment in the Florida Kidcare program, all additional
6 enrollment must cease and additional enrollment may not resume
7 until sufficient funds are available to finance such
8 enrollment. The Florida Healthy Kids Corporation may enroll
9 additional Title-XXI-eligible children if funding for this
10 additional enrollment is derived solely from other funding
11 sources meeting Title XXI guidelines and if federal matching
12 funds are available.
13 Section 2. This act shall take effect upon becoming a
14 law.
