  1                      A bill to be entitled

  2         An act relating to fire protection systems;

  3         amending s. 471.025, F.S.; requiring

  4         professional engineers to seal all final bid

  5         documents; amending s. 633.021, F.S.; providing

  6         a definition of the term "layout"; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 471.025, Florida Statutes, is

12  amended to read:

13         471.025  Seals.--

14         (1)  The board shall prescribe, by rule, a form of seal

15  to be used by registrants holding valid certificates of

16  registration.  Each registrant shall obtain an impression-type

17  metal seal in the form aforesaid and may, in addition,

18  register his or her seal electronically in accordance with ss.

19  282.70-282.75.  All final drawings, specifications, plans,

20  reports, or documents prepared or issued by the registrant and

21  being filed for public record and final bid documents provided

22  to the owner or the owner's representative shall be signed by

23  the registrant, dated, and stamped with said seal. Such

24  signature, date, and seal shall be evidence of the

25  authenticity of that to which they are affixed.  Drawings,

26  specifications, plans, reports, final bid documents, or

27  documents prepared or issued by a registrant may be

28  transmitted electronically and may be signed by the

29  registrant, dated, and stamped electronically with said seal

30  in accordance with ss. 282.70-282.75.

  1         (2)  It is unlawful for any person to stamp, seal, or

  2  digitally sign any document with a seal or digital signature

  3  after his or her certificate of registration has expired or

  4  been revoked or suspended, unless such certificate of

  5  registration has been reinstated or reissued. When the

  6  certificate of registration of a registrant has been revoked

  7  or suspended by the board, it shall be mandatory that the

  8  registrant, within a period of 30 days after the revocation or

  9  suspension has become effective, surrender his or her seal to

10  the secretary of the board and confirm to the secretary the

11  cancellation of the registrant's digital signature in

12  accordance with ss. 282.70-282.75.  In the event the

13  registrant's certificate has been suspended for a period of

14  time, his or her seal shall be returned to him or her upon

15  expiration of the suspension period.

16         (3)  No registrant shall affix or permit to be affixed

17  his or her seal, name, or digital signature to any plan,

18  specification, drawing, final bid document, or other document

19  that which depicts work which he or she is not licensed to

20  perform or which is beyond his or her profession or specialty

21  therein.

22         Section 2.  Present subsections (13) through (26) of

23  section 633.021, Florida Statutes, are redesignated as

24  subsections (14) through (27), respectively, and a new

25  subsection (13) is added to that section to read:

26         633.021  Definitions.--As used in this chapter:

27         (13)  "Layout" as used in this chapter means the layout

28  of risers, cross mains, branch lines, sprinkler heads, sizing

29  of pipe, hanger locations, and hydraulic calculations in

30  accordance with the design concepts established through the

31  provisions of s. 553.79(6)(c).

  1         Section 3.  This act shall take effect  upon becoming a

  2  law.

  4          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  5                         Senate Bill 1064

  6

  7  The Committee Substitute for Senate Bill 1064, requires
    professional engineers to sign, date, and seal final bid
  8  documents provided to the owner or the owner's representative,
    and defines "layout" for purposes of the fire prevention and
  9  control statutes.
