3 Authority, Palm Beach County; amending ss. 4,
4 8, ch. 82-259, Laws of Florida, as amended;
5 providing for appointment and terms of members
6 of the authority; revising eligibility
7 requirements for members; revising quorum
8 requirements for meetings of the authority;
9 revising procedures for selecting or
10 terminating an airport manager; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 4 of chapter 82-259, Laws of
16 Florida, as amended by section 1 of chapter 91-381, Laws of
17 Florida, and section 1 of chapter 99-421, Laws of Florida; and
18 section 8 of chapter 82-259, Laws of Florida, are amended to
19 read:
20 Section 4. Membership; terms of office; officers;
21 quorum; meetings; removal.--
22 (1) The authority shall consist of seven members. As
23 a condition of eligibility for appointment and to hold office,
24 five members must reside within the municipality, and two
25 members must reside within the Greater Boca Raton Reserve
26 Area, as defined in chapter 67-1112, Laws of Florida. Of the
27 five municipal residents, three must reside east of U.S.
28 Interstate Highway 95 the airport, one must reside west of
29 U.S. Interstate Highway 95 the airport, and one may reside
30 anywhere in the municipality.

1 (2) The county commission shall appoint two members,
2 each of whom must reside within the Greater Boca Raton Reserve
3 Area. The city council shall appoint the five members who must
4 reside within the limits of the municipality as specified in
5 subsection (1).
6 (3) The term of office for each member shall be 2 two
7 years. Each term shall expire on June 1 in the year of
8 expiration of the term. The terms of office of three city
9 council appointees expire in even-numbered years and the terms
10 of office of the remaining city council appointees expire in
11 odd-numbered years. The county and Boca Raton Pilots
12 Association members' terms shall expire in odd-numbered odd
13 years and the other members' terms shall expire in even years.
14 (4) A chairman, vice chairman, and secretary shall be
15 chosen by and from the authority membership. The term of
16 office for the chairman, vice chairman, and secretary shall be
17 1 one year, and no member shall hold the same office for more
18 than two consecutive terms.
19 (5) A quorum shall consist of four three members, but
20 the affirmative vote of not fewer less than four three members
21 is shall be necessary to take any action except to adjourn.
22 (6) The authority shall meet at least once each month
23 at such times and places within the city as shall be
24 determined by the authority.
25 (7) Any member may be removed by the commission or
26 council which appointed that member, but only for grounds
27 constituting misfeasance, malfeasance, or nonfeasance in
28 office, or upon conviction of any crime. The unexcused
29 failure to attend three consecutive regular meetings of the
30 authority shall be deemed nonfeasance, without limiting the
31 meaning of that term.

1 (8) Vacancies in office shall be filled by the
2 appropriate appointing entity for the balance of the term.
3 Each appointment to fill a vacancy shall be made from a list
4 of nominees furnished by the entity which nominated the member
5 who held the office. In such cases, the list of nominees
6 shall be filed not later than 30 days after notice of the
7 vacancy has been given to the nominating entity.
8 Section 8. Airport manager.--The authority shall
9 employ an aviation-experienced airport manager to administer
10 all airport operations and to supervise all airport projects.
11 The decision to employ or terminate the employment of the
12 airport manager shall require the four-fifths vote of four the
13 members of the authority.
14 Section 2. This act does not affect the term of office
15 of any person serving on the Boca Raton Airport Authority on
16 the effective date of this act.
17 Section 3. This act shall take effect July 1, 2000.
