  1                      A bill to be entitled

  2         An act relating to elections; amending s.

  3         104.091, F.S.; providing that a person who

  4         agrees, conspires, combines, or confederates

  5         with another person to commit a violation of

  6         The Florida Election Code is punishable as if

  7         he or she committed the violation; providing

  8         that a person who knowingly aids, abets, or

  9         advises another person who has violated the

10         code, with intent for that person to avoid

11         detection, arrest, or prosecution, is

12         punishable in like manner as the principal

13         offender; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Section 104.091, Florida Statutes, is

18  amended to read:

19         104.091  Aiding, abetting, or advising, or conspiring

20  in a violation of the code.--

21         (1)  Any person who shall knowingly aids aid, abets,

22  abet or advises in advise the violation of this code shall be

23  punished in like manner as the principal offender.

24         (2)  Any person who agrees, conspires, combines, or

25  confederates with another person to commit a violation of this

26  code shall be punished as if he or she had actually committed

27  the violation.

28         (3)  Any person who knowingly aids, abets or advises

29  another person who has violated this code, with the intent

30  that the principal offender avoid detection, arrest, or

  1  prosecution, shall be punished in like manner as the principal

  2  offender.

  3         Section 2.  This act shall take effect July 1, 2000.

  6                          SENATE SUMMARY

  7    Provides that a person who agrees, conspires, combines,
      or confederates with another person to commit a violation
  8    of the election code shall be punished as if he or she
      committed the violation. Provides that a person who
  9    knowingly aids, abets, or advises another person who has
      violated the code, with intent for that person to avoid
10    detection, arrest, or prosecution, shall be punished in
      like manner as the principal offender.
