17 Section 1. Subsection (5) of section 162.04, Florida
18 Statutes, is amended to read:
19 162.04 Definitions.--As used in ss. 162.01-162.13, the
20 term:
21 (5) "Repeat violation" means a violation of a
22 provision of a code or ordinance by a person who has been
23 previously found through a code enforcement board or any other
24 quasi-judicial or judicial process, to have violated or who
25 has admitted violating the same provision within 5 years prior
26 to the violation, notwithstanding the violations occur at
27 different locations. Except in the case of a public nuisance,
28 this subsection shall not apply to owners of property
29 regulated under chapter 723, this subsection shall apply to
30 owners of a unit located on the property. Owners of property
31 regulated under chapter 723, shall be subject to all other
