1 A bill to be entitled
2 An act relating to gun-free zones; authorizing
3 the governing body of a municipality or county
4 to establish a gun-free zone pursuant to an
5 ordinance approved by the governing body or
6 approved by a vote of the electors; requiring
7 that signs be posted to notify the public of a
8 gun-free zone; requiring that law enforcement
9 officers and security officers who carry
10 firearms be exempt from any ordinance
11 establishing a gun-free zone; providing a
12 penalty; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Establishment of gun-free zones.--
17 (1) The governing body of a municipality or county may
18 establish one or more gun-free zones within the municipality
19 or county pursuant to an ordinance approved by a vote of the
20 governing body or approved by a majority of the electors
21 within the municipality or county voting in a referendum held
22 on the question of the creation of the gun-free zone.
23 (2) Following the approval of a gun-free zone, the
24 governing body shall provide for posting clearly legible signs
25 at conspicuous locations to notify the public of the gun-free
26 zone.
27 (3) The ordinance establishing the gun-free zone shall
28 provide an exemption for any state or federal law enforcement
29 officer or security officer, as defined in section 493.6101,
30 Florida Statutes, who carries a firearm in the performance of
31 his or her official duties.

1 (4) Any person who possesses a firearm in a gun-free
2 zone in violation of the ordinance establishing the gun-free
3 zone commits a felony of the third degree, punishable as
4 provided in section 775.082, section 775.083, or section
5 775.084, Florida Statutes.
6 Section 2. This act shall take effect upon becoming a
7 law.

10 SENATE SUMMARY
11 Provides for one or more gun-free zones to be established
by the governing body of a municipality or county
12 pursuant to an ordinance approved by the governing body
or by vote of the electors. Requires that signs be posted
13 to notify the public of the gun-free zone. Requires that
the ordinance provide an exemption for law enforcement
14 officers and security officers who carry firearms.
Provides that it is a third-degree felony to violate an
15 ordinance establishing a gun-free zone.
