  2         An act relating to Miami-Dade County; providing

  3         for the relief of Frank J. Ruck, Jr., and

  4         Marlene G. Ruck, individually and as Personal

  5         Representatives of the Estate of Christopher F.

  6         Ruck; providing for an appropriation to

  7         compensate them for the death of Christopher F.

  8         Ruck as a result of the negligence of

  9         Miami-Dade County; providing an effective date.

11         WHEREAS, on June 16, 1996, Christopher F. Ruck was

12  riding his bicycle in Miami Beach, Florida, and

13         WHEREAS, while riding his bicycle in a lawful manner,

14  Christopher Ruck was struck and killed by a Miami-Dade bus,

15  and

16         WHEREAS, Miami-Dade County has admitted that the bus

17  driver was 100 percent at fault for the accident and the death

18  of Christopher Ruck, and

19         WHEREAS, Christopher Ruck was survived by his parents,

20  Frank Ruck and Marlene Ruck, and

21         WHEREAS, Frank Ruck and Marlene Ruck, parents of

22  Christopher Ruck, brought suit against Miami-Dade County, and

23         WHEREAS, prior to trial, Miami-Dade County and the

24  plaintiffs agreed to a compromise settlement in the amount of

25  $1,000,000, and

26         WHEREAS, Miami-Dade County has paid $200,000 to Frank

27  Ruck and Marlene Ruck, pursuant to the limits of liability set

28  forth in section 768.28, Florida Statutes, and agrees to

29  support a claim bill in the amount of $800,000, NOW,

30  THEREFORE,

  1  Be It Enacted by the Legislature of the State of Florida:

  2

  3         Section 1.  The facts stated in the preamble to this

  4  act are found and declared to be true.

  5         Section 2.  Miami-Dade County is authorized and

  6  directed to appropriate from funds of the county not otherwise

  7  appropriated and to draw a warrant in the sum of $800,000

  8  payable to Frank J. Ruck, Jr., and Marlene G. Ruck, as

  9  Personal Representatives of the Estate of Christopher F. Ruck,

10  as compensation for the death of Christopher F. Ruck due to

11  the negligence of Miami-Dade County.

12         Section 3.  This act shall take effect upon becoming a

13  law.
