1 A bill to be entitled
2 An act relating to sexual predators; amending
3 s. 775.21, F.S.; requiring a sexual predator to
4 report in person to a driver's license office
5 within a specified period after the predator's
6 name is changed by reason of marriage or other
7 legal process; requiring that the Department of
8 Highway Safety and Motor Vehicles forward such
9 information to the Department of Law
10 Enforcement and the Department of Corrections;
11 providing a penalty; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Paragraph (g) of subsection (6) and
17 paragraph (a) of subsection (10) of section 775.21, Florida
18 Statutes, are amended to read:
19 775.21 The Florida Sexual Predators Act; definitions;
20 legislative findings, purpose, and intent; criteria;
21 designation; registration; community and public notification;
22 immunity; penalties.--
23 (6) REGISTRATION.--
24 (g) Each time a sexual predator's driver's license or
25 identification card is subject to renewal, and within 48 hours
26 after any change of the predator's residence or change in the
27 predator's name by reason of marriage or other legal process,
28 the predator shall report in person to a driver's license
29 office, and shall be subject to the requirements specified in
30 paragraph (f). The Department of Highway Safety and Motor
31 Vehicles shall forward to the department and to the Department

1 of Corrections all photographs and information provided by
2 sexual predators. Notwithstanding the restrictions set forth
3 in s. 322.142, the Department of Highway Safety and Motor
4 Vehicles is authorized to release a reproduction of a
5 color-photograph or digital-image license to the Department of
6 Law Enforcement for purposes of public notification of sexual
7 predators as provided in this section.
8 (10) PENALTIES.--
9 (a) Except as otherwise specifically provided, a
10 sexual predator who fails to register; or who fails, after
11 registration, to maintain, acquire, or renew a driver's
12 license or identification card; who fails to or provide
13 required location information or change-of-name information;,
14 or who otherwise fails, by act or omission, to comply with the
15 requirements of this section, commits a felony of the third
16 degree, punishable as provided in s. 775.082, s. 775.083, or
17 s. 775.084.
18 Section 2. This act shall take effect July 1, 2000.

21 SENATE SUMMARY
22 Requires that a sexual predator report any legal change
in his or her name to a driver's license office within 48
23 hours after the change. Provides that it is a
third-degree felony to fail to report such information.
24 Requires the Department of Highway Safety and Motor
Vehicles to forward the change-of-name information to the
25 Department of Law Enforcement and the Department of
Corrections.
