11  Senator Brown-Waite moved the following amendment:

13         Senate Amendment 

14         On page 48, line 28, through

15            page 49, line 4, delete those lines

16

17  and insert:  granted by s. 16.56 or s. 27.04, obtained in

18  furtherance of an investigation of any crime in this section,

19  including any crime listed as specified unlawful activity

20  under this section or any felony violation of chapter 560, has

21  immunity from criminal liability and shall not be liable to

22  any person for any lawful action taken in complying with the

23  warrant, temporary injunction, or other court order, including

24  any subpoena issued under the authority granted by s. 16.56 or

25  s. 27.04. If any subpoena issued under the authority granted

26  by s. 16.56 or s. 27.04 contains a nondisclosure provision,

27  any financial institution, licensed money transmitter,

28  employee or officer of a financial institution or licensed

29  money transmitter, or any other person may not notify,

30  directly or indirectly, any customer of that financial

31  institution or licensed money transmitter whose records are

 1  being sought by the subpoena, or any other person named in the

 2  subpoena, about the existence or the contents of that subpoena

 3  or about information that has been furnished to the state

 4  attorney or statewide prosecutor who issued the subpoena or

 5  other law enforcement officer named in the subpoena in

 6  response to the subpoena.
