  1                      A bill to be entitled

  2         An act relating to the public educational

  3         institutions; amending s. 228.2001, F.S.;

  4         prohibiting discrimination under any education

  5         curriculum based on race, national origin, sex,

  6         handicap, or marital status by a public

  7         educational institution that receives or

  8         benefits from federal or state financial

  9         assistance; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (a) of subsection (2) of section

14  228.2001, Florida Statutes, is amended to read:

15         228.2001  Discrimination against students and employees

16  in state system of public education; prohibitions; equality of

17  access; strategies to overcome underrepresentation;

18  remedies.--

19         (2)(a)  Discrimination on the basis of race, national

20  origin, sex, handicap, or marital status against a student or

21  an employee in the state system of public education is

22  prohibited. No person in this state shall, on the basis of

23  race, national origin, sex, handicap, or marital status, be

24  excluded from participation in, be denied the benefits of, or

25  be subjected to discrimination under any education program,

26  curriculum, or activity, or in any employment conditions or

27  practices, conducted by a public educational institution that

28  which receives or benefits from federal or state financial

29  assistance.

30         Section 2.  This act shall take effect upon becoming a

31  law.
