1 A bill to be entitled
2 An act relating to the Department of
3 Transportation; amending s. 316.1895, F.S.;
4 directing the department to provide for
5 pedestrian crosswalks with pedestrian control
6 devices at all public elementary schools and
7 middle schools in the state under certain
8 circumstances; amending s. 334.044, F.S.;
9 requiring the department to cooperate with
10 local entities to alleviate specified hazardous
11 walking conditions; providing an effective
12 date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsections (1) and (2) of section
17 316.1895, Florida Statutes, are amended to read:
18 316.1895 Establishment of school speed zones,
19 enforcement; designation.--
20 (1)(a) The Department of Transportation, pursuant to
21 the authority granted under s. 316.0745, shall adopt a uniform
22 system of traffic control devices and pedestrian control
23 devices for use on the streets and highways in the state
24 surrounding all schools, public and private.
25 (b) The Department of Transportation shall compile,
26 publish, and transmit a manual containing all specifications
27 and requirements with respect to the system of devices
28 established pursuant to paragraph (a) to the governing body of
29 each county and municipality in the state, and the Department
30 of Transportation and each county and municipality in the

1 state shall install and maintain such traffic and pedestrian
2 control devices in conformity with such uniform system.
3 (c) As part of the uniform system of traffic and
4 pedestrian control devices established pursuant to paragraphs
5 (a) and (b), the Department of Transportation may include
6 school speed limit zones for schools on all public roads, when
7 identified by a local school district.
8 (2) Upon request from the appropriate local government
9 or district school board, the Department of Transportation
10 shall install and maintain such traffic and pedestrian control
11 devices on state-maintained roads as prescribed in this
12 section for all prekindergarten early-intervention schools
13 that receive federal funding through the Headstart program and
14 all public and private elementary schools and middle schools.
15 Section 2. Present subsections (23) through (30) of
16 section 334.044, Florida Statutes, are redesignated as
17 subsections (24) through (31), respectively, and a new
18 subsection (23) is added to that section to read:
19 334.044 Department; powers and duties.--The department
20 shall have the following general powers and duties:
21 (23) To cooperate with local governments and district
22 school boards to alleviate hazardous walking conditions as
23 described in s. 234.021.
24 Section 3. This act shall take effect July 1, 2000.

4 The CS provides FDOT may include school speed zones on all
public roads when identified by a local school board.

The CS requires FDOT to install and maintain traffic control
6 devices for all public and private elementary, middle schools
(removes the requirement in bill for high school and
7 alternative schools) upon the request of a local government or
district school board.

The CS requires FDOT to cooperate with local governments and
9 district school boards to alleviate hazardous walking
conditions.
