17 Section 34. Subsections (5) and (6) are added to
18 section 376.303, Florida Statutes, to read:
19 376.303 Powers and duties of the Department of
20 Environmental Protection.--
21 (5) MAPPING.--If an institutional control is
22 implemented at any contaminated site in a brownfield area
23 designated pursuant to s. 376.80, the property owner must
24 provide information regarding the institutional control to the
25 local government for mapping purposes. The local government
26 must then note the existence of the institutional control on
27 any relevant local land use and zoning maps with a
28 cross-reference to the department's site registry developed
29 pursuant to subsection (6). If the type of institutional
30 control used requires recording with the local government,
31 then the map notation shall also provide a cross-reference to

1 the book and page number where recorded. When a local
2 government is provided with evidence that the department has
3 subsequently issued a no-further-action order without
4 institutional controls for a site currently noted on such
5 maps, the local government shall remove the notation.
6 (6) REGISTRY.--The department shall prepare and
7 maintain a registry of all contaminated sites located in a
8 brownfield area designated pursuant to s. 376.80, which are
9 subject to institutional and engineering controls, in order to
10 provide a mechanism for the public and local governments to
11 monitor the status of these controls, monitor the department's
12 short-term and long-term protection of human health and the
13 environment in relation to these sites, and evaluate economic
14 revitalization efforts in these areas. At a minimum, the
15 registry shall include the type of institutional or
16 engineering controls employed at a particular site, types of
17 contaminants and affected media, land use limitations, and the
18 county in which the site is located. Sites listed on the
19 registry at which the department has subsequently issued a
20 no-further-action order without institutional controls shall
21 be removed from the registry. The department shall make the
22 registry available to the public and local governments within
23 1 year after the effective date of this act. The department
24 shall provide local governments with actual notice when the
25 registry becomes available. Local zoning and planning offices
26 shall post information on how to access the registry in public
27 view.
