5 for a permitting program under part IV of ch.
6 373, F.S., in the Northwest Florida Water
7 Management District; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Subsections (6) and (7) of section
13 373.4145, Florida Statutes, are amended to read:
14 373.4145 Interim part IV permitting program for the
15 Northwest Florida Water Management District.--
16 (6) Subsections (1), (2), (3), and (4) shall be
17 repealed upon the effective date of rules adopted under
18 paragraph (7)(c) effective July 1, 2003.
19 (7)(a) The department and the Northwest Florida Water
20 Management District are directed to begin developing a plan by
21 which the permitting for activities proposed in surface waters
22 and wetlands shall fully comply with the provisions of this
23 part, beginning July 1, 2001 2003. The plan also shall address
24 the division of environmental resource permitting
25 responsibilities between the department and the Northwest
26 Florida Water Management District; the methodology of
27 delineating wetlands in the Northwest Florida Water Management
28 District; authority of the Northwest Florida Water Management
29 District to implement federal permitting programs related to
30 activities in surface waters and wetlands; and the chapter 70
31 implications of implementing the provisions of this part

1 within the jurisdiction of the Northwest Florida Water
2 Management District.
3 (b) The department and Northwest Florida Water
4 Management District shall jointly prepare a an interim report
5 on their progress in developing the aforementioned plan, to be
6 presented January March 1, 2001, to the Governor, the
7 President of the Senate, the Speaker of the House of
8 Representatives, and the chairs of the relevant substantive
9 and fiscal committees. The department and district shall
10 present a final report on March 1, 2003.
11 (c) The department and the Northwest Florida Water
12 Management District may adopt rules implementing all or a
13 portion of the Management and Storage of Surface Water Program
14 under part IV as described in the progress report under
15 paragraph (7)(b) which are substantially equivalent to those
16 in effect in the rest of the state. The rules must be ready
17 for adoption by October 1, 2001, unless the adoption is
18 challenged.
19 (d)(c) Any jurisdictional declaratory statement issued
20 for a project within the geographic jurisdiction of the
21 Northwest Florida Water Management District that is valid on
22 July 1, 1999, and for which there has been issued a permit
23 pursuant to this chapter and chapter 403 for a phase of that
24 project and which identified proposed future development,
25 including mitigation, that would require an additional permit
26 pursuant to this chapter and chapter 403 shall not expire
27 until January 1, 2002.
28 Section 2. This act shall take effect upon becoming a
29 law.
