  1                      A bill to be entitled

  2         An act relating to warehousemen liens; amending

  3         s. 677.209, F.S.; providing for a lien on goods

  4         covered by an electronic notification of

  5         receipt; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (1) of section 677.209, Florida

10  Statutes, is amended to read:

11         677.209  Lien of warehouseman.--

12         (1)  A warehouseman has a lien against the bailor on

13  the goods covered by a warehouse receipt or an electronic

14  notification of receipt of such goods or on the proceeds

15  thereof in his or her possession for charges for storage or

16  transportation (including demurrage and terminal charges),

17  insurance, labor, or charges present or future in relation to

18  the goods, and for expenses necessary for preservation of the

19  goods or reasonably incurred in their sale pursuant to law.

20  If the person on whose account the goods are held is liable

21  for like charges or expenses in relation to other goods

22  whenever deposited and it is stated in the receipt that a lien

23  is claimed for charges and expenses in relation to other

24  goods, the warehouseman also has a lien against him or her for

25  such charges and expenses whether or not the other goods have

26  been delivered by the warehouseman.  But against a person to

27  whom a negotiable warehouse receipt is duly negotiated a

28  warehouseman's lien is limited to charges in an amount or at a

29  rate specified on the receipt or if no charges are so

30  specified then to a reasonable charge for storage of the goods

  3         Section 2.  This act shall take effect October 1, 2000.
