14         On page 133, lines 16-18, delete those lines

15

16  and insert:

17         Section 60.  Sections 216.001, 216.0154, 216.0162,

18  216.0166, 216.0172, 216.0235, 216.0315, 216.091, 216.111,

19  216.281, and 216.286, Florida Statutes, are repealed.

20         Section 61.  Section 27.38, Florida Statutes, is

21  amended to read:

22         27.38  Budget transfer authority.--

23         (1)  Notwithstanding s. 216.292, each state attorney,

24  whenever he or she deems it necessary by reason of changed

25  conditions, may transfer appropriations funded from identical

26  funds as prescribed in s. 215.32, except appropriations for

27  fixed capital outlay, and transfer the amounts included within

28  the total original approved budget and releases as furnished

29  pursuant to ss. 216.181 and 216.192, as follows:

30         (a)  Between categories of appropriations within a

31  budget entity, if no category of appropriation is changed by

 1  more than $150,000 $100,000 plus 5 percent of the original

 2  approved budget by all action taken under this subsection.

 3         (b)  Additionally, between budget entities within

 4  identical categories of appropriations, if no category of

 5  appropriation is changed by more than $150,000 $100,000 plus 5

 6  percent of the original approved budget by all action taken

 7  under this subsection.

 9  Such authorized revisions, together with related changes, if

10  any, in the plan for release of appropriations, shall be

11  transmitted by the state attorney to the Comptroller for entry

12  in his or her records in the manner and format prescribed by

13  the Executive Office of the Governor in consultation with the

14  Comptroller.  A copy of such revision shall be furnished the

15  Executive Office of the Governor, the chairs of the

16  legislative appropriations committees, and the Auditor

17  General.

18         (2)  Notwithstanding provisions to the contrary in s.

19  27.34(2), a state attorney may expend appropriated state funds

20  for items which are enumerated in that subsection.

21         (3)  Each state attorney shall, no later than October 1

22  of each fiscal year, submit a report to the legislative

23  appropriations committees showing the amount of state funds

24  expended during the previous fiscal year ending in June for

25  the items enumerated in s. 27.34(2).  The Justice

26  Administrative Commission shall prescribe the format.

27         Section 62.  Section 27.60, Florida Statutes, is

28  amended to read:
