17 Section 61. Section 27.38, Florida Statutes, is
18 amended to read:
19 27.38 Budget transfer authority.--
20 (1) Notwithstanding s. 216.292, each state attorney,
21 whenever he or she deems it necessary by reason of changed
22 conditions, may transfer appropriations funded from identical
23 funds as prescribed in s. 215.32, except appropriations for
24 fixed capital outlay, and transfer the amounts included within
25 the total original approved budget and releases as furnished
26 pursuant to ss. 216.181 and 216.192, as follows:
27 (a) Between categories of appropriations within a
28 budget entity, if no category of appropriation is changed by
29 more than $150,000 $100,000 plus 5 percent of the original
30 approved budget by all action taken under this subsection.
31 (b) Additionally, between budget entities within

1 identical categories of appropriations, if no category of
2 appropriation is changed by more than $150,000 $100,000 plus 5
3 percent of the original approved budget by all action taken

6 Such authorized revisions, together with related changes, if
7 any, in the plan for release of appropriations, shall be
8 transmitted by the state attorney to the Comptroller for entry
9 in his or her records in the manner and format prescribed by
10 the Executive Office of the Governor in consultation with the
11 Comptroller. A copy of such revision shall be furnished the
12 Executive Office of the Governor, the chairs of the
13 legislative appropriations committees, and the Auditor
14 General.
15 (2) Notwithstanding provisions to the contrary in s.
16 27.34(2), a state attorney may expend appropriated state funds
17 for items which are enumerated in that subsection.
18 (3) Each state attorney shall, no later than October 1
19 of each fiscal year, submit a report to the legislative
20 appropriations committees showing the amount of state funds
21 expended during the previous fiscal year ending in June for
22 the items enumerated in s. 27.34(2). The Justice
23 Administrative Commission shall prescribe the format.
24 Section 62. Section 27.60, Florida Statutes, is
25 amended to read:
26 27.60 Budget transfer authority.--

30 funds as prescribed in s. 215.32, except appropriations for
