11  The Committee on Regulated Industries recommended the

12  following amendment:

14         Senate Amendment (with title amendment) 

15         Delete everything after the enacting clause

17  and insert:

18         Section 1.  Subsection (1) of section 350.031, Florida

19  Statutes, is amended to read:

20         350.031  Florida Public Service Commission Nominating

21  Council.--

22         (1)  There is created a Florida Public Service

23  Commission Nominating Council consisting of nine members. At

24  least one member of the council must be 60 years of age or

25  older.  Three members, including one member of the House of

26  Representatives, shall be appointed by and serve at the

27  pleasure of the Speaker of the House of Representatives; three

28  members, including one member of the Senate, shall be

29  appointed by and serve at the pleasure of the President of the

30  Senate; and three members shall be selected and appointed by a

31  majority vote of the other six members of the council. All

 1  terms shall be for 4 years except those members of the House

 2  and Senate, who shall serve 2-year terms concurrent with the

 3  2-year elected terms of House members. Vacancies on the

 4  council shall be filled for the unexpired portion of the term

 5  in the same manner as original appointments to the council. A

 6  member may not be reappointed to the council, except for a

 7  member of the House of Representatives or the Senate who may

 8  be appointed to two 2-year terms or a person who is appointed

 9  to fill the remaining portion of an unexpired term.

10         Section 2.  This act applies to any person who is a

11  member of the Florida Public Service Commission Nominating

12  Council on the effective date of this act.

13         Section 3.  This act shall take effect upon becoming a

14  law.

30         limiting the number of full terms to which a

31         member may be appointed; providing for
